Regulatory Actions

CRK&L advises individuals and businesses in connection with investigations and proceedings before a wide variety of regulatory bodies including inquiries by the SEC, FINRA, FTC, OFAC, the NYS Department of Taxation and Finance, the NYS Insurance Department, the NYS Department of Labor, and the NYS Department of Health. CRK&L is one of the few law firms ever to defeat the SEC at trial before the SEC’s own administrative law judge, winning a dismissal of all charges against a hedge fund operator.

CRK&L prosecutes and defends a broad range of complex business and employment disputes, representing both individuals and corporate entities in state and federal courts in the New York metropolitan area, nationwide, and internationally. We appear regularly in court, and before regulatory bodies. We have successfully litigated cases involving multi-million dollar commercial disputes, insurance claims, financial disputes, securities arbitrations, and many others.

Employment Law and Litigation

CRK&L represents employees and employers in a broad spectrum of matters including advisory services related to compliance, negotiations of employment agreements, and litigation and dispute resolution. Our experience spans a variety of industries, including financial services, private equity, start-up companies, health care, media and advertising, sports and entertainment, and hospitality. Our attorneys have extensive experience in representing employees in negotiations regarding compensation, equity, post-employment restrictions, and other terms and conditions of employment. We litigate on behalf of employees and employers in state and federal courts, arbitration tribunals (such as AAA, JAMS and FINRA), and regulatory agencies (including the EEOC, NYC Commission on Human Rights and NYS Division of Human Rights). We advise employers on complying with city, state and federal laws, including discrimination, sexual harassment, and wage and hour. We also assist employers in navigating sensitive situations involving employee discipline and termination.

Appeals

CRK&L maintains an active civil and criminal appellate and post-conviction practice in state and federal courts throughout the country. Our attorneys argued the first post- Skilling “honest services” appeal before the US Court of Appeals for the Second Circuit. We have represented a major banking institution appealing a tax assessment by New York City before the Supreme Court of the State of New York, Appellate Division, First Department and argued a novel right to counsel of choice issue before the New York Court of Appeals.
