Accompanying the launch of the Patent Law of the People's Republic of China, China Patent Agent (H.K.) Ltd. (CPA) was established in Hong Kong in March 1984 and is one of the three pioneer Chinese IP agencies. CPA provides comprehensive IP services to clients in China and abroad, with particular expertise in application prosecution, litigation, mediation, licensing, assignment, and counseling relating to various areas of IP including patent, trademark, copyright, domain name, and anti-unfair competition. CPA also prosecutes patent, trademark and design applications for clients in the Hong Kong SAR. Apart from its Hong Kong-based main office, the firm also has offices in Beijing, Shenzhen, Shanghai, New York, Tokyo and Munich.

As one of the most time-honoured IP agencies in China, CPA leads the industry in terms of excellence, diversity and scale of its corporate operation. It now has 540 staff members, including 230 patent attorneys, 34 trademark attorneys, and 85 attorneys-at-law. Main Areas of Practice

Patent

CPA's patent team assembles a host of professionals who are familiar with domestic and foreign intellectual property (IP) cases and combine rich IP knowledge with solid practical experience. The team currently has 200-plus patent attorneys, and more than half of them have been in related practice for over 10 years, with expertise covering all aspects of technical sectors including computer, communication, electronics, physics, machinery, chemistry, materials, medicine, and biology. Furthermore, a number of them have the valuable experience of formerly working as examiners at the State Intellectual Property Office (predecessor of China National Intellectual Property Administration), and 150-plus in the team also possess patent litigator qualification.

The patent team's service scope covers patent application consultation, patent search and analysis, patent mining and portfolio management, patent drafting and filing, responding to office action, reexamination and invalidation proceedings, administrative litigation, annuity management, as well as patent registration in Hong Kong and Macao. Working languages of the team include English, Japanese, German, French, Chinese, and Cantonese.

CPA's patent team is one of the earliest professional teams in China qualified with the capability to handle foreign-related patent agency matters. It now provides full-range patent-related services to thousands of overseas clients, including Fortune 500 companies. The team members are well-versed in IP laws in China as well as major industrial countries and regions such as the United States, Japan, and Europe. The team maximises the value of clients' inventions and wins trust from clients. To date, the team has handled hundreds of thousands of patent filings on behalf of foreign clients, and secures a grant rate higher than the industry average. Members of CPA's patent team have an international perspective, regularly visiting law firms in the United States, Europe, and Japan for further education and learning, which allows them to stay updated with the latest IP developments overseas and actively engage in international IP cooperation.

Trademark

CPA's trademark team operates from its Hong Kong headquarters and Beijing office, under the respective trademark departments thereof, as well as from its offices in the United States, Germany, and Japan. The team comprises about 40 trademark attorneys, a majority of them being graduates of eminent universities in China or overseas with over 10 years' experience in trademark practice and having attained professional proficiency recognition including the National Judicial Examination, Test for English Majors Grade Eight, Japanese-Language Proficiency Test Grade One, and China Trademark Association (CTA)'s trademark attorney proficiency test. And many of them are winners of CTA's Gold Medal Trademark Attorney and candidates on the list of CTA's talent pool, having received training in overseas law firms on trademark law of foreign jurisdictions and accumulated rich experience in trademark agency practice. Furthermore, CPA's trademark team has the support of the firm's 130-strong litigators, who can be of service in case of post-registration proceedings, in particular administrative and civil trademark litigation.

The service scope of the team covers trademark consultation, search and watch, application and renewal, assignment, changes, license recordation, opposition, cancellation, appeal for review, administrative litigation, customs recordation, customs action and protection, domain name registration and disputes, registration of copyright for works and software, and brand design, portfolio and strategy. Working languages of the team include English, Japanese, German, Chinese, and Cantonese.

The trademark team's clients range from individuals, start-ups to global 500 corporations from home and abroad. In terms of operation, the team is further divided into specialised units to focus respectively on trademark prosecution for foreign applicants, for mainland Chinese applicants, and for applications in Hong Kong and Macao, as well as for trademark litigation.Leveraging the team members' familiarity of trademark laws and practices of China and other jurisdictions combined with extensive experience in full-range intellectual property (IP) services, CPA's trademark prosecution units provide clients with myriad trademark services and are particularly adept in advising enterprises on how to avoid risks, defuse obstacles, and formulate trademark portfolio and management strategy plans; and its trademark litigation unit provides trademark infringement consultation, and assist clients in administration litigation, and civil litigation; whereas Hong Kong and Macao unit's services cover trademark registration application and protection, search, opposition, cancellation and invalidation in Hong Kong and Macao, as well as global trademark services for Hong Kong and Macao applicants.

Legal Affairs

CPA has a strong legal service team, comprising 160-plus litigators from its Legal Affairs Department as well as various business departments across its headquarters and branch offices, among them 70-plus are attorneys-at-law. The Legal Affairs Department has 15 professionals, who all are graduates of eminent universities in China or abroad, with a majority of them having a doctoral or master's degree, whose specialties include machinery, chemistry, biology, electricity, communication, and law. Most members of the team have received training overseas and some of them have attained U.S. patent agent qualification. They are familiar with intellectual property (IP) laws of China, the United States, Japan, and Europe, and their working languages include Chinese, English, German, and Japanese. The team has won wide acclaim and recognition from clients and peers over the years, reflecting its effective synergy, robust knowledge base, profound understanding of laws, substantial practical experience, and remarkable performance in handling of cases.
