Energy & Environment:

Norway has the highest share of renewable energy production in Europe, and Lund & Co is one of the largest and most prominent energy law firms in Norway. The firm advises on all matters related to the energy sector, from the planning stage to renewal and revision of existing licenses, including environmental issues, tax matters, restructuring, M&A, corporate law and sale or purchase of power in the market. Lead partners Stinessen and Lund are among Norway’s most experienced lawyers in the field. They have since the 1980s consistently represented a high number of municipalities, power companies and land owners.

M&A:
Lund & Co advises clients on mergers, acquisitions, demergers, corporate restructurings, as well as related regulatory matters, particularly in the energy sector. This includes both public and private transactions. In 2017 Larsen and Strand assisted Kvikne-Rennebu Kraftlag SA with a sale of assets and corporate restructuring. Sogn and Fjordane County is the major owner of Sogn og Fjordane Energi AS, one of Norway’s largest energy companies. Lund & Co is currently legal adviser to evaluate and execute a restructuring of the county’s ownership in Sogn and Fjordane Energi AS. The team is led by partners Larsen and Bjørgan.

Taxation:
Lund & Co has a comprehensive tax practice and have a special expertise on tax matters concerning natural resources, renewable energy and property. The firm frequently litigates tax disputes in court. In 2017 the team litigated two tax-cases in the Supreme Court: Partners Lund and Rogan represented several municipalities in a case against Statnett, the public company who controls Norway’s high voltage electricity transmission grid. The case concerned fundamental principles of valuation and the scope and extent of judicial review of local tax authorities’ assessment. Partner Rogan also represented Sauda municipality in third-party intervention in a case between the tax authorities and Saudefaldene AS. The question was which company had fiscal ownership to a hydropower plant.

Real Estate:
The firm represents small land owners, public entities, municipalities and some of the biggest private land owners in Norway. The firm is currently advising on several cases concerning various property rights, long term leases, construction projects, expropriation and compensation for conservation/ protected areas. The firm cooperates with several national organisations of landowner, farmers, forest owners and holders of various property rights, such as Norges Bondelag (Norwegian farmers’ Union) and Norske Lakseelver (Norwegian association for holders of salmon fishing rights). Partner Stinessen currently advises several municipalities on land acquisition for various public projects.

EU/EEA:
Lund & Co have extensive experience in advising public and private clients in the fields of EEA state aid, competition, free movement and public procurement law. Lund & Co acts as adviser for several ministries, business and political organisations, undertakings and private individuals. Partner Bjørgan was Director of the Competition and State Aid Directorate of the EFTA Surveillance Authority before joining Lund & Co. Lund & Co currently advises clients on EEA law related matters in cases pending before the EFTA Court, national courts and the EFTA Surveillance Authority.

Litigation & Arbitration:
The partners Lund, Stinessen, Larsen, Bjørgan and Rogan are admitted to the Bar of The Supreme Court. The partners and most of the associates spend more than 50 % of their time with dispute resolution. Lund & Co has a litigation team with extensive dispute resolution experience in private, public and business law. In the last two years the firm has been involved in six Supreme Court cases in the field of tax law, financial services, contract law, public law, real estate, damages, bankruptcy and energy/natural resources law. Bjørgan has acted in approximately 25 cases before the EFTA Court, the Court of Justice and the General Court in Luxembourg. He represents the Norwegian Ski Federation in a pending EFTA Court case concerning marketing rights, free movement of services and competition law.
