We advise contractors and contracting authorities in proceedings under the Public Procurement Law and the Act on Concessions for Construction Works and Services, as well as in implementation of projects via public-private partnerships.
We draft all necessary documents for contractors during procedures for award of public contracts, including contractors cooperating as a consortium or relying on the capacity of third parties.
We draft, review, and provide opinions on tender documentation for contracting authorities (e.g. description of the subject matter of the contract, terms of reference, and contract conditions). We also provide ongoing advice during the course of tender proceedings (e.g. participating in negotiations with bidders, support in evaluating bids, establishing the final wording of the contract, and clarifying abnormally low bids).
We verify applications for admission to procurement proceedings and bids for compliance with the law. We also represent contractors, contracting authorities and contracting entities in review proceedings, before the National Appeal Chamber and the Public Procurement Court.
We advise on the eligibility of expenses incurred at each stage of project completion. We also provide legal assistance involving ex ante review of contracts and annexes concluded by beneficiaries of EU funds.
We examine the admissibility of modifications to public contracts and identify risks associated with contract performance.
