Spencer West's Senior Executive Employment team has seen further growth and advised on an increasingly broad range of high-value, complex, sensitive and cross-border contentious and non-contentious matters across a range of industries and sectors. Matters include advising C-suite, board level and a range of other senior executives against large corporates, leading financial institutions, charities, foundations and government bodies. This ranges from discrimination and harassment to whistle-blowing and appearing across employment courts from the Employment Tribunal to the High Court.
The team is also highly active advising senior executives on non-contentious matters that are often critical to their career, including negotiation of non-compete provisions and exit strategies. The team’s work has an increasingly international and cross-border element, in particular handle cross-jurisdictional issues and potential claims. These typically arise when senior executives have worked across international offices or faced discrimination during secondments or postings in other jurisdictions, hold Directorships or offices in global group companies, or have the benefit of share options typically arising out of US entities.
The team has seen development in EDI cases, particularly where employees complain of being hired to improve EDI but experience a lack of inclusion, culminating in dismissal and ill-health and discrimination involving neurodiversity.
