The Team is dedicated to merger-control and antitrust/competition issues, both at national and EU levels.
Merger-Control. The firm has a strong reputation in French and European merger control, acting in high-profile cases for parties to the operation or on the contrary for third parties wishing to oppose a merger. For instance, the firm assisted Bolloré in its sale of Bolloré Logistics to CMA CGM and Bolloré Africa Logistics to MSC, Vivendi in its takeover bid over Lagardère, Veolia in its €13 Billion takeover bid over Suez, or VINCI in its strategic acquisition of ACS’s energy business. The firm also advised a third party regarding the TFI-M6 merger in the TV sector.
Antitrust. The team assists clients in antitrust/competition litigation before French and European competition authorities, and their related jurisdictions. Recent antitrust highlights include the annulment by the Paris Court of Appeal of the €384 million fines imposed to several banks (incl. our client BNP Paribas), the reduction of circa €100 million fine imposed to Servier as the EU General Court found that the Commission made a series of errors in defining the relevant market, or the partial annulment of the EU Commission decision authorising dawn raids at Casino’s premises.
The firm also advises in other behavioral litigation cases such as numerous claims for damages further to anti-competitive practices, restrictive and unfair competition practices.
