About

Provided by Ogier

Ogier's Dispute Resolution team in Cayman is one of the largest in the jurisdiction and has acted in some of the largest and most complex insolvencies before the Cayman courts in recent years, including Abraaj, Constellation, Ocean Rig, AHAB, and Kuwait Port Fund.

With a pedigree in local and cross-border trust dispute resolution, we:

  • act for trustees, settlors, protectors, enforcers and beneficiaries in relation to high value international trust disputes, including breach of trust, forced heirship and rectification claims, Hastings-Bass applications, and claims involving the exculpation and indemnity of trustees
  • provide advice for banks, financial intermediaries and corporates, as well as onshore counsel and other professional services providers in connection with company structures
  • act and advise with respect to enforcement of foreign judgments, including acting for foreign governments and other judgment creditors seeking to enforce foreign judgments in Cayman

Our team is regularly asked to provide expert evidence in respect of foreign proceedings concerning various aspects of Cayman Islands law. Additionally, we acted in the first Cayman case to consider the effect of the Trusts Law Foreign Element Provisions as regards an attempt to enforce foreign matrimonial orders purporting to vary a Cayman trust.
