The Trusts team has a wealth of experience in complex trust matters. Our clientele spans HNW and UHNW individuals, private banks, trust companies, family offices and private companies.

The Trust team is notably strong in the area of trust litigation. Given their expertise, many Lennox Paton attorneys serve on government advisory boards. The team is significantly bolstered by consultant Dr. David Hayton, a former Judge of the Caribbean Court of Justice and co-author of Underhill and Hayton, Law of Trusts and Trustees, one of the leading textbooks for practitioners.

The team has been consistently shortlisted for major awards in the “Offshore Firm of the Year” category and is the first and only Bahamian law firm to be shortlisted for such awards.

Work Highlights:

• Matteo Volpi v Delanson Services Limited and Gabriele Volpi - a Supreme Court decision which provided important clarification on the jurisdictional limits of the Bahamian Court to assist in trust arbitration proceedings. Brian Simms QC and Marco Turnquest successfully appeared in both the Supreme Court and Court of Appeal in the landmark decision on service out of the jurisdiction and Section 91A of the Trustee Amendment Act, 2011.
• Cromwell Trust Matter v Cheryl Hamersmith-Stewart v Cromwell Trust Company Limited et al concerning the family trust established by the founder of Sandals Resorts. We are representing the Trustee in hostile litigation involving various family beneficiaries.
