Restructuring/Insolvency

Glatzova & Co. has broad experience with virtually all kinds of practical approaches to restructuring and insolvency proceedings, e.g.:

• We advised a debtor in one of the fastest reorganization processes in the Czech Republic and participated in preparing the reorganization plan that gained the support of the vast majority of creditors (KARA Trutnov). In 2022 alone, we prepared three other reorganization plans.
• We also advised debtors on out of court (informal) restructurings and divestments processes, resulting in a 100 % recovery of the creditors’ claims (including claims of banking creditors). One such out of court restructuring was in the real estate sector (Golden office) and another was in the heavy industry sector (which is heavily impacted by the war in Ukraine) (the client does not want to be named due to the pending process).
• We represented a group of entities in incidental proceedings on contesting actions (actio pauliana) against the insolvency trustee of the debtor (Arca Investments’ insolvency).
• In the past year, we also advised our clients in connection with restructuring of banking/private equity debts attributable to the COVID 19 pandemic situation and related state aid as well as in connection with the energy crisis.
• We have actively participated in almost all major insolvency proceedings in the Czech Republic in the past 10 years, including OKD, Vítkovice Power Engineering, Vítkovice Gearworks, Mladá fronta, PSJ, and NWT.
