Overview

Our team of approximately 20 restructuring and insolvency specialists advises on all aspects of Dutch insolvency law and is involved in leading and high profile (international) insolvency procedures. We assist financial institutions, borrowers, creditors, debtors and other stakeholders in complex (cross border) restructuring and insolvency related cases. Our team also advises companies and their directors and supervisory directors on asset based lending, multi jurisdiction restructuring and work out scenarios and on all issues relating to directors’ and officers’ liability.

The Dutch courts regularly appoint members of the group as silent administrator, administrator and bankruptcy trustee in high-profile insolvency proceedings. The team is acknowledged for its expertise in handling financial restructurings and insolvency proceedings (involving foreign bondholders), large consumer retail bankruptcies and real estate investment funds bankruptcies.

CMS Netherlands is the only major Dutch law firm that as part of an international firm maintains and further develops a substantial and high profile administration and insolvency court appointment practice and has committed itself to continuing doing so in future.
