Our team of restructuring and insolvency specialists is an integrated part of the full service banking & finance department of CMS NL (which comprises of 19 lawyers in total) and advises on all aspects of Dutch insolvency law and is involved in leading and high profile (international) insolvency procedures. We assist financial institutions, borrowers, creditors, debtors and other stakeholders in complex (cross border) restructuring and (international) insolvency related cases. Our team also advises companies and their directors and supervisory directors on asset based lending, multi jurisdiction restructuring and work out scenarios and on all issues relating to directors’ and officers’ liability. The team litigates for this group of clients in these areas of law.

The team’s approach is down to earth, pragmatic and much appreciated in the market.

The Dutch courts regularly appoint members of the group as silent administrator, administrator and bankruptcy trustee in high-profile insolvency proceedings in a wide variety of business areas. The team is widely acknowledged for its special expertise in handling financial restructurings and insolvency proceedings (involving foreign bondholders), large consumer retail bankruptcies and real estate (including hotel and leisure) investment funds bankruptcies.
