The ASA has recently published its ruling on same‑day voucher redemption windows. The ruling concerned a betting shop gaming‑machine promotion that printed a voucher at 11:51 offering “£5 cash match on any game”, but the voucher was only redeemable later the same day, from 17:20–23:59. For it to be eligible, £50+ must have been staked before 17:20. The ASA held this promotion encouraged irresponsible play by incentivising customers to stay longer or return to gamble again the same day, and therefore breached CAP Code rule 8.5.

This decision was upheld; the ad must not reappear in this form.

CAP Code 8.5 (protection of consumers, safety and suitability) states that promotions must not be socially undesirable to the audience addressed by encouraging excessive consumption or irresponsible use.

Practical guidance for land-based gambling operators:

  1. Avoid compressed, same‑day redemption windows. Do not structure rewards so that qualification occurs earlier the same day, but redemption is only available later that day. Next‑day or longer windows to claim should be used, so customers are not nudged to remain or to make a second visit to premises to gamble again.
  2. Re‑think stake‑threshold mechanics. Be cautious with eligibility thresholds that can be hit via re‑staked winnings within a short period; this can be read as encouraging repeated play. Consider longer qualifying periods or alternative criteria not linked to intensive short‑term staking.
  3. Evidence that the promotion is not socially undesirable. Before launch, document a risk assessment addressing time pressure, repeat‑play incentives, and visit‑frequency effects; record why the promotion does not encourage excessive play and any mitigations (e.g., longer redemption windows, low‑risk mechanics). Note that general mitigations will not cure a design that inherently incentivises intensive play.
  4. Align copy and terms with CAP Section 8. Ensure promotional materials reflect CAP Code rule 8 principles, especially rule 8.5; if space‑limited, signpost complete terms clearly and avoid any framing implying time‑sensitive pressure to play.
  5. Governance and pre‑clearance. Run internal legal/compliance checks on “cash match”, “free play”, or voucher offers; consider CAP Copy Advice for borderline mechanics; record decision‑making and keep management information (redemption, dwell time, return visits) to show ongoing oversight.
