Witness Familiarisation - Case Preparation.
Witness evidence is vital. A witness who fails to carry out structured preparation and is ignorant of the process is placed at a huge disadvantage. Their evidence may be lost, distorted or manipulated if they do not have the skills and confidence to ensure that their evidence is understood by the decision maker(s).
The session reassures witnesses by explaining the stages in the hearing and their role in giving evidence. The sessions offer detailed guidance and a methodology to help witnesses prepare for a hearing by considering the weight, reliability and credibility of evidence. The firm are unique in providing a case preparation plan to be implemented by witnesses when preparing to give their own evidence. This equips witnesses with a methodology to identify strengths and weaknesses in their evidence and to handle documents at the hearing. Witnesses learn how to present their evidence to maximise the impact of facts and documents.
Witnesses receive tips on how to present evidence effectively by calmly managing a range of cross-examination techniques. The tutors use simple visual aide memoires to demystify the role of the witness to help witnesses give clear confident and credible evidence. The session helps them to identify what evidence to present, how to present it and demonstrate why it is important.
Feedback from witnesses and instructing lawyers has indicated that the session is highly effective in getting witnesses to set aside time to fully engage with, and prepare for, the hearing. It enables the witness to spend time going through their evidence with a clear purpose.
Intensive Cross-Examination Role Play.
Our barrister/solicitor tutors are highly skilled in using a range of realistic and challenging cross-examination techniques. The role play demonstrates how witness evidence is undermined and compared with evidence in an opposing party’s statements, exhibits or reports. The firm do not merely work off short scenarios in which the witness is questioned only on one side’s evidence. This is artificial. The tutors use a range of different cross-examination techniques to give a witness the experience of intense scrutiny of evidence during a hearing. Witnesses are provided with specific tips on the different techniques used in cross-examination and learn how to manage these. The cross-examination role play is stopped every 5 minutes to give structured feedback. This helps to build skills and confidence in witnesses as they go along and to incrementally improve their skills.
The tutor will work with the witness to remove the blockers to effective communication due to anxiety, lack of confidence, anger, aggression or other characteristics. This assists with posture, tone, speed of delivery, precision and accuracy in language. Tips are given on the psychology of giving evidence and how to use techniques to remain calm and focussed. Witnesses leave with a toolkit of skills to present their evidence effectively, calmly and with clarity. Intensive cross-examination role play can be arranged to take place immediately after Case Preparation or after a gap in time to allow for reflection and to implement the case preparation methodology on the case study to be used for the cross-examination role play.
The firm has unrivalled experience working with expert witnesses giving evidence in high value complex cases. The firm are able to support experts who have recently been instructed by delivering sessions on expert witness report writing and preparing for and conducting expert meetings. Too often experts find themselves with reports that will not support their evidence giving or without the skills required to effectively conduct an expert meeting.
