Firm Overview:
Founded in 1929, Krieger Mes & Graf v. der Groeben is widely regarded as one of Germany’s leading law firms in the field of intellectual property. It focuses on litigation and advice/counselling with regard to intellectual property rights. The firm has a particular reputation for its work in the patent litigation sector. While experienced in all kinds of intellectual property and unfair competition litigation, all lawyers working in the firm have a keen interest and particular training and experience in patent litigation. It is regarded as one of the firm’s strengths to acquire an in-depth understanding of the most complex technical matters in order to convey the relevant technical facts and their legal implications to courts and other bodies.

The firm’s lawyers represent their clients before all German District Courts and Courts of Appeal, before the Federal Patent Court and the Federal Supreme Court (in nullity action appeals), before the European Court of Justice and the European Court of First Instance, before other authorities concerned with intellectual property and product piracy as well as in arbitration proceedings. The firm’s clients include national and international corporations of every size and business sector, with a focus on technology-based companies. Members of the firm hold leading positions in the AIPPI, are active in GRUR, and act as co-editors of the well-known German intellectual property monthly GRUR.

Main Areas of Practice:
All lawyers working in the firm provide comprehensive legal advice regarding the enforcement of intellectual property rights in Germany, above all with respect to patent (or utility model) infringement litigation. That involves out-of-court advice with regard to a potential infringement of patents, IP strategy, (license) negotiations with opponents, and comprehensive activity and advice in relation to patent infringement lawsuits before German courts. Mostly in connection with infringement litigation, the firm also advises and represents clients in nullity actions before the Federal Patent Court and the Federal Supreme Court (only together with patent attorneys). Employee inventors or employer companies are represented in disputes regarding employees’ inventions remuneration. The firm is also hugely experienced in conducting litigation and providing advice concerning other intellectual property rights (designs, trademarks, copyrights) or unfair competition and antitrust laws. In addition, the firm has considerable experience in drafting and negotiating license agreements regarding intellectual property and know-how, both in connection with and independent from pending infringement litigation. The firm further provides comprehensive legal advice to companies with regard to shaping their advertising and marketing campaigns in Germany.

The firm represents large and middle-sized European, US and Asian companies in all industry and technology sectors, in particular in the chemical, biotechnology, pharmaceutical, engineering, automotive, telecommunications, electrical, electronics, consumer electronics and medical devices sectors. It is the policy of the firm not to publish the names of their clients.

International Work:
Krieger Mes & Graf v. der Groeben regularly acts for international corporations from Europe, the US and Asia, in particular in the context of large, concerted patent litigation campaigns involving, alongside Germany, other European and/or US jurisdictions. The firm has excellent contacts to foreign law and patent attorney firms equally specialising in patent litigation and advice/counselling in Europe and the US, which contacts are utilised also in the course of such concerted actions.
