Admitted to the Bar, joined Hiratsuka & Co and registered as maritime counsellor in 2002, Partner in 2006, University of Southampton, Maritime Law Short Course in 2007, Listed on the Arbitrators of the Japan Shipping Exchange, Inc. Tokyo Maritime Arbitration Commission since 2020.
After his qualification in 2002, Shinichiro Yamashita has experienced large number of cases of Maritime & Shipping (both dry and wet), such as cargo claim, LOI claim, charterparty/COA/shipbuilding contract disputes, sale and purchase of the second hand vessels, handling cases of collision/fire/grounding/pollution/salvage/port facility damage/general average, environmental regulation, negotiation with relevant Japanese authorities, arrest/release of vessels and bankruptcy of shipping company. He has worked for Japanese and non-Japanese shipping companies, trading houses, H&M underwriters, P&I clubs, cargo underwriters, shipbuilders, NVOCCs, brokers, directly or via foreign law offices. Also he has handled air transport and land transport cases.
He has accumulated experience in the area of Insurance & Reinsurance as well. For regulatory matters, he has advised business regulation in Japan for non-Japanese clients. He has been appointed by the Commissionar of Financial Service Agency of Japan as the liquidator of Japan branch of foreign insurance provider. For policy claim matters, he has advised to non-Japanese clients for various types of insurance and reinsurance which are governed by Japanese law. Further he has been appointed by insurer/reinsurer for recourse claims against a party causing incident as well as product recall cases in which insured is involved.
He has been well instructed for Litigation & Arbitration, including but not limited to product liability litigation in Japan, arbitration in Tokyo, corporate litigation between foreign head office and Japanese managing director, labour tribunal proceedings in Japan, mediation in Japan, provisional attachment of assets, execution of foreign court's judgment in Japan and execution of arbitration awards in Japan. To assist Japanese clients for overseas legal proceedings, he has worked with attorneys-at-law in foreign jurisdictions. He has been instructed to provide legal opinions regading Japanese laws and customs for foreign governments, courts and arbitral tribunals.
