Professor Philippe Stoffel-Munck, a Swiss and French national, registered at the Paris Bar, presently acts mainly as an arbitrator (co-arbitrator, sole arbitrator or chairman). He has more than fifteen years of experience in this field, covering international cases or domestic cases, mainly under the rules of arbitral institutions such as the ICC (International Chamber of Commerce), the LCIA (London Court of International Arbitration), the SAC (Swiss Arbitration Center), the AFA (French Association for Arbitration), the CFACI (Franco-German Chamber of Commerce), the CAIP (International Arbitration Center of Paris), the CMAP (Arbitration and Mediation Center of Paris), as well as ad hoc proceedings. He sat in about fifty cases between 2010 and 2025. His areas of expertise cover inter alia Post Acquisition Litigation, Shareholders’ Agreements, Joint Ventures, Aeronautic industry, Supply Agreements, Distribution Agreements, Professional liability (bankers, lawyers, etc.), Product Liability, Telecommunication, FRAND licensing, and New Technologies.
Career
Professor Stoffel-Munck is a tenured law professor at the University of Paris 1 Panthéon-Sorbonne since 2005 and, in parallel to his academic position, has gained substantial experience of law in practice as a legal expert and, subsequently, as an arbitrator in complex cases pertaining to civil law systems. At Panthéon-Sorbonne University, which is ranked as being the best university in France for Law by the 2024 QS Rankings by subject, he teaches undergraduate and graduate courses related to his research interests, such as contract law, tort law, law of security interests, and arbitration. His primary academic interest has been French law of contracts since his PhD, which focused on the abuse of rights, unfair contractual terms, and duty of good faith. After obtaining his PhD summa cum laude, he was entitled to apply to the concours d’agrégation de droit privé et de sciences criminelles, which is the highest national competitive examination for civil service as a tenured professor in French public universities. He ranked first nationwide. In 2018, he was appointed by the French Ministry of Higher Education to sit as one of the seven members of the national examination board of the 2018-2019 concours d’agrégation de l’enseignement supérieur for the recruitment of private law full professors in French public universities. In addition to his academic contributions, he took part in the reform of French contract law (2016) and was subsequently appointed by the Ministry of Justice to preside the Law commission tasked with drafting the reform of the French law of Contrats spéciaux, which encompasses contracts of sale, lease, loans, services, agency. The report of the commission was officially submitted in April 2023. Over the years, he has also lectured, as a guest professor at leading institutions, including the Universities of Montreal (2007), Waseda (Tokyo, 2011) and Oxford (2013), among other places. Parallel with his academic position, Professor Stoffel-Munck has acted since 2003 as a consultant and legal expert in French law, acting before French Courts as well as before arbitral tribunals, and also before the High Court of England and Wales or in the context of proceedings before U.S. Courts. He acted as Of Counsel in the Clifford Chance Paris office between 2005 and 2017.

Professor Stoffel-Munck is a member of the Scientific Board of the well-known law journals Revue des contrats (Lextenso), Semaine Juridique (Lexis Nexis) and Cahiers du droit de l’entreprise. He is also a member of various arbitration associations, such as CFA (Comité Français de l'Arbitrage), ASA (Swiss Arbitration Association), AFA (Association Française d’Arbitrage), or the arbitration committee of the IBA (International Bar Association).

Professor Stoffel-Munck is a prolific author. For fifteen years, he has written the quarterly Torts and contractual Liability column in La Semaine Juridique and still contributes to the Contracts Law column in the Revue des contrats, which are both prominent law journals in France. He publishes in the Revue de l'arbitrage (e. g. "L’arbitrage et l’adaptation des contrats de durée (LTA)", Rev. arb., 2025; "La responsabilité de l’arbitre", Rev. arb., 2017 or other arbitration journals (e.g. “Good Faith in Civil Law”, in Good faith in International Arbitration, ASA Special Series, No. 49, Wolters Kluwer, 2024). He has written or co-authored a number of textbooks including Les obligations (with Ph. Malaurie and L. Aynès, coll. Droit civil, 13th ed., LGDJ, 2024), Droit de la responsabilité et des contrats (with Ph. le Tourneau, Dalloz Action, 2008), L’abus dans le contrat (LGDJ, 2000). He also supervised the collective book studying the draft reform of French contract law, Réforme du droit des contrats et pratique des affaires (Dalloz, 2015), and the book explaining the draft reform of the law of specific contract that was prepared by the law commission he chaired (L’avant-projet de réforme du droit des contrats spéciaux, LGDJ, 2023).
