Pablo Xavier Berger Crespo

Pablo Berger is a founding partner of BMA Legal, with a practice split between complex litigation and corporate/M&A work. He has more than ten years of experience in dispute resolution, advising on civil, commercial, constitutional, criminal and administrative matters, and has represented local and international clients in claims exceeding US$400 million across sectors including telecommunications, banking and finance, and port and maritime affairs.

On the corporate side, he advises local and international companies on capital structuring, mergers and acquisitions, and commercial contracts, working across the full transaction cycle from structuring through closing. His practice combines litigation and transactional experience, which he applies to disputes with a commercial and regulatory dimension and to transactions with contentious risk.

Pablo Berger has more than 10 years of practice. Before founding Berger, Martínez & Asociados (BMA Legal), he worked at recognised, top-tier law firms in Guatemala, building the foundation for his current practice. He holds a law degree (Abogado y Notario) from Universidad Francisco Marroquín, an MBA from the Pontificia Universidad Católica de Chile, and postgraduate studies in Criminal Law and Corporate Law from Universidad del Istmo. As founding partner of BMA Legal, his practice spans two core areas: corporate, commercial and transactional work — advising local and international clients on capital structuring, project development, M&A and civil/commercial contracts — and dispute resolution, where he has more than 9 years' experience handling preventive and reactive civil, commercial, constitutional, criminal and administrative disputes, including claims exceeding US$400 million.

He is a member of the Colegio de Abogados y Notarios de Guatemala and belongs to several trade chambers, including AGEXPORT and the Guatemalan Chamber of Commerce, among others.

Pablo's client base is concentrated in two core practices — litigation (civil, commercial, criminal, constitutional, administrative and labour litigation, as well as arbitration) and corporate & M&A — which he applies across a focused set of industries rather than a broad generalist offering. He regularly advises clients in real estate, immigration, fintech, telecommunications, renewable energy and intellectual property matters, acting for local and international companies that need both transactional guidance and contentious representation within the same relationship.

Advised a company in the port and maritime sector on litigation and negotiation strategy in a nullity dispute, spanning corporate and contentious matters. Represented a telecommunications-sector client nationwide in unconstitutionality actions, amparos, and administrative litigation. Advised clients in the beverage and consumer goods sector on commercial disputes and litigation. Advised energy-sector companies, as well as oil and gas companies, on litigation matters.

Corporate & Transactional

Advised on the structuring of real estate investment funds. Advised fintech and entertainment-sector companies from initial incorporation through day-to-day operations. Advised on project development and capital raising.
