Ognjen has extensive experience in group actions, commercial work and jurisdictional disputes, appearing in landmark cases and representing both claimants and defendants. He also focuses on product liability, particularly where it intersects with these areas of specialism.
He was instructed as Junior Counsel for the Claimants in the Post Office Group Litigation, during which successful judgments were obtained in relation to several important areas of law. More significantly, the litigation helped to uncover what has frequently been described in the media as the “largest miscarriage of justice in British legal history”.
Outside of a purely domestic context, Ognjen has been instructed in many cases that have been brought in the UK by groups of claimants from all over the world. These cases are often founded on alleged international mass torts, and include the seminal decisions of the Supreme Court in Lungowe v Vedanta and the Court of Appeal in AAA v Unilever. Cases in this arena provide significant judicial guidance on matters of jurisdiction and liability within corporate groups.
Ognjen is also instructed by the Claimants in multiple group actions arising from ‘emissions’ claims against different vehicle manufacturers, as well as in the Diesel Particulate Filter Group Action brought against Jaguar Land Rover Limited.
In terms of unitary commercial work, Ognjen is currently instructed in a case arising from a BIT arbitration award made against the Czech Republic (worth c.£570m today). He was instructed as Junior Counsel for the claimant agency in a dispute with the Ecclestone family and an associated entity for recovery of substantial sums. The commercial relationship centred on the design, marketing and distribution of products and the operations of salons associated with Ms Tamara Ecclestone’s name. Ognjen has recently been instructed to defend a claim brought by a boxing promoter which alleges that its prior ‘Head of Boxing’ took actions which prevented it from reaching a new agreement with Sky UK Ltd. The claim, which is strongly disputed, is alleged to have resulted in lost income of approximately £30m and has already involved a contested interim injunction hearing.
Ognjen has also been instructed in multiple TCC claims for claimants and defendants in relation to a variety of different products.
