Prior to joining Tiger Partners, Min XU served as a dispute resolution lawyer at King & Wood Mallesons (2012-2016) and Fangda Partners (2016-2020).

Represented a prominent film investment company in handling investment contract and guarantee disputes with a domestic cultural and entertainment enterprise and its founder in the Tianjin Binhai New District People’s Court and the Beijing Arbitration Commission. The case, with a dispute amount of approximately RMB 23 million, involved complex contractual issues such as the enforceability of guaranteed investment clauses, set-off of creditor and debtor rights, and the impact of force majeure. Mr. Xu successfully achieved a comprehensive victory for the client in both litigation and arbitration proceedings, securing full repayment by preserving additional receivables in the enforcement process.

Represented a well-known private equity fund in disputes with a domestic tech startup and its founder regarding shareholder rights litigation in two levels of courts in Hangzhou, as well as a dispute over a share repurchase agreement in the Beijing Arbitration Commission. The case, with a dispute amount of approximately RMB 200 million, involved intricate legal issues, such as the founder’s use of related-party transactions to damage company interests. Mr. Xu leveraged shareholder rights litigation to obtain crucial evidence, ultimately achieving a full victory for the client in the share repurchase arbitration case.

Represented a large domestic securities company in a litigation concerning equity transfer and repurchase rights with a private enterprise before the Beijing High People’s Court. With a dispute amount of approximately RMB 1 billion, this case involved complex legal issues such as the enforceability of shareholder repurchase obligations and the legality of a multi-layer trust structure. Mr. Xu secured a complete victory for the client at trial.

Mr. Xu secured a comprehensive victory for the client at trial.

The case, with a dispute amount of approximately RMB 40 million, involved complex legal issues such as the legality of limited partnership share transfers and the enforceability of pre-distribution clauses in partnership income. Mr. Xu achieved a complete victory for the client.

Represented a state-owned trust company in a series of corporate resolution validity disputes with a state-owned shareholder in the Beijing Second Intermediate People’s Court and the Beijing Xicheng District People’s Court. This series of cases involved complex legal issues such as the legality of board and shareholder meeting procedures, statutes of limitation on rights to revoke resolutions, distinctions between rescission and nullity of resolutions, and the impact of capital increases on minority shareholders. Represented a state-owned enterprise group in Yunnan in a bulk commodity financing and sale contract dispute with a local private enterprise in the Kunming Intermediate People’s Court and the Yunnan High People’s Court. The case, with a dispute amount of approximately RMB 160 million, involved complex legal issues such as the authenticity of financing circulation trades and the evidence and determination of joint liability for sole shareholder liability. Mr. Xu obtained a comprehensive victory, absolving the client from joint liability.

Represented a Hong Kong-based real estate investment fund in a warehouse lease contract dispute with a private enterprise in the Tianjin First Intermediate People’s Court, involving a dispute amount of approximately RMB 30 million. This case dealt with complex issues such as the interpretation of multiple breach clauses, complex calculations of rent and penalties, and the double-counting of penalties and actual losses. Mr. Xu secured a full victory for the client.

Represented a prominent U.S. multinational in a financial leasing contract dispute with a private enterprise in the Shenyang Intermediate People’s Court and the Liaoning High People’s Court. With a dispute amount of approximately RMB 20 million, the case raised complex legal issues such as the formation requirements of contracts, debt assumption, and product defect determinations. Mr. Xu achieved a comprehensive victory, enabling the client to avoid any default liability.

Represented a well-known Hong Kong real estate development company in a construction project bid and contract dispute with a general contractor in mainland China. The case, with a dispute amount of approximately RMB 300 million, involved complex legal issues such as delays, project quality, cost assessment, and migrant worker wage protection. Due to the client’s time-sensitive needs, Mr. Xu successfully facilitated multiple rounds of negotiations with counterparties and relevant government departments, reaching a swift settlement that preserved the client’s rights and prevented costly project delays.

Represented a state-owned private equity fund in a partnership share return and repurchase dispute with the parent company of a private listed company before the China International Economic and Trade Arbitration Commission, with a dispute amount of approximately RMB 200 million. Through legal and commercial advantages, Mr. Xu successfully negotiated a pre-litigation settlement, recovering the client’s debt.

Represented an asset management company in a lending and mortgage contract dispute with a domestic real estate enterprise and participated in the enterprise’s bankruptcy reorganization process before the Shanghai Third Intermediate People’s Court. The case, with a dispute amount of approximately RMB 120 million, involved complex issues such as priority conflicts between mortgage rights and expectant property rights and procedural handling of debt assignment during creditor claim declarations. Mr. Xu, representing the priority creditor, engaged in multiple rounds of negotiation with the bankruptcy administrator and restructuring investor, ultimately facilitating the approval of the reorganization plan by the court.
