Practice Areas
Marco Martinelli is an expert in administrative law, with a particular focus on public economic law.
He has gained extensive experience in administrative litigation, providing judicial assistance before Regional Administrative Courts, the Council of State, and the Court of Cassation, as well as before European judicial authorities in all areas of administrative law. His expertise is particularly strong in public contracts (procurement, concessions, and Public-Private Partnerships), strategic infrastructures of national interest, services of general economic interest, public entity finance, project financing, energy, urban planning, construction, publicly owned companies under the Consolidated Law on Publicly Owned Companies (T.U.S.P.) as per Legislative Decree 175/16, procedures for granting public financial aid, and proceedings before independent and regulatory authorities (AGCM, AGCOM, ANAC, ARERA, the Transport Authority, CONSOB, and the Bank of Italy).
He also assesses public law aspects in corporate acquisition, merger, and transfer procedures, as well as in the privatization of public companies and the disposal of public assets. Additionally, he has developed significant experience in matters concerning so-called “golden power,” distortive foreign subsidies under EU Regulation 2022/2560, and administrative-accountability cases before the Court of Auditors.
Career
He graduated with honors in Law from "La Sapienza" University of Rome in 2000 and obtained a Ph.D. in Administrative Law in May 2006 from the Department of European Law at the Faculty of Law of Roma Tre University.
Since 2003, he has been a lecturer at the National School of Administration as a recognized expert in the field. He is also an adjunct professor at Guglielmo Marconi University and teaches in the most prestigious second-level master's programs in administrative law. Previously, he taught at the School of Specialization for Legal Professions at La Sapienza University, covering courses in administrative law and administrative justice. He frequently participates as a speaker in various training courses organized by Paradigma S.r.l. and industry conferences.
He has authored numerous articles, essays, and case law commentaries on public procurement, state aid, cultural heritage, public services, and administrative justice. He is a member of the Administrative Law Advisory Commission of the Rome Bar Association and has been authorized to represent clients before higher courts since 2015.
He joins LEXIA in January 2025 after practicing as a lawyer in leading law firms.
