Career
Ms Małgorzata Krasnodębska-Tomkiel is a Polish solicitor and Doctor of Law. Prior to co-founding Hansberry Tomkiel in 2014, she worked at the Polish Office of Competition and Consumer Protection (the “Authority”). From 2008-2014, she served as the Authority’s Chairman. Previously, she served as a Vice-Chairman and as the Head of the Legal Department. As the Chairman of the Authority, she managed an organization of over 460 employees, which included nine regional offices throughout Poland. Her duties as Chairman included the protection and enforcement of the EU and Polish competition laws. During her tenure as Chairman, her office issued over 4,600 decisions.
She brings exceptional experience to Hansberry Tomkiel’s clients subject to investigations by the Authority and the European Commission as well as other Member States’ Competition Authorities. As a practitioner, she has excelled. Her clients are diverse and come from the energy, media, telecommunications, publishing and manufacturing sectors. Ms Krasnodębska-Tomkiel is well versed in new technologies and how to advise clients on the intersection of these industries with the competition and consumer protection laws. She has overlooked a number of the Firm’s litigation cases, including a plaintiff private damage action case.
She is recognized and valued for providing the Firm’s clients with balanced and excellent representation.
During this ranking period, she took part in the following events:
• • On October 29, 2024, the GC Summit Poland 2024 conference took place, organized by Legal500. Among the speakers at the conference were Małgorzata Krasnodębska-Tomkiel and Dorota Podsiedzik-Malec, partners at the Law Firm. They presented the threats and challenges to consumer protection posed by new technologies and shared their experience and knowledge on how entrepreneurs can avoid or minimize such threats.
• Lawyers from Hansberry Tomkiel conducted classes as part of an online workshop entitled ‘Competition protection in a dynamic market environment – key challenges and strategies’ organised by MMC Polska. The workshop took place on 5-6 December. During the workshop, Małgorzata Krasnodębska-Tomkiel, PhD, discussed the topic ‘Exchange of confidential information and competition law – risks for business’, and Grzegorz Materna discussed ‘UOKiK inspections and searches – how to prepare and what you need to know’. .
• Małgorzata Krasnodębska-Tomkiel spoke at the 16th Competition Law Congress organised by the Puls Biznesu daily newspaper (27.11.2024), giving a presentation on ‘The prohibition of parallel trade in practice – the EC's decision on Mondelez and its implications for the functioning of distribution systems’.
• On March 5 2025 Ms Krasnodębska-Tomkiel and Grzegorz Materna gave presentation at the breakfast workshop organised by Hansberry Tomkiel in cooperation with the Irish-Polish Chamber of Commerce. The speech was on the rules governing the purchase and sale of goods and services online.
Participants had the opportunity to learn and discuss:
- UOKiK’s role in regulating the online sales of products and services
- Recent UOKiK decisions and investigations regarding consumer protection issues
- Examples of competition protection cases in digital markets
- How to mitigate risks and reduce likelihood of a UOKiK investigatory proceedings?
• Ms Krasnodębska-Tomkiel spoke at the 4th Consumer Law Congress organised by the Puls Biznesu daily newspaper (9.06.2025). She moderated the panel discussion entitled ‘Public compensation – current trends in the case law of the President of the Office of Competition and Consumer Protection and the courts’.
• Ms Krasnodębska-Tomkiel spoke at the European Competition Day (26 organized by the Office of Competition and Consumer Protection (UOKiK) as part of Poland's EU Presidency in a panel discussion entitled ‘The promise of more innovative and flexible competition interventions and their pro-competitive market effects’.
