Lavinia advises trustees, beneficiaries and executors on a range of trust and succession disputes, both in the UK and offshore.
Career
Lavinia studied Law with French Law at the University of Oxford, including a year studying at Université Paris II: Panthéon-Assas. She trained at Bircham Dyson Bell and qualified in October 2016. Lavinia joined Stewarts in February 2021.

Lavinia assists in the resolution of trust disputes and has experience acting for trustees, beneficiaries and protectors in UK-based and offshore trusts.
She also advises on disputes arising in the administration of estates, including challenges to the validity of wills, claims under the Inheritance (Provision for Family and Dependants) Act and challenges to the actions of executors of estates.
Lavinia has experience in commercial litigation, which brings a useful angle to trust disputes. She has also acted on a number of appeals to the Judicial Committee of the Privy Council.
Lavinia has experience advising on disputes relating to multi level marketing schemes.

Lavinia’s recent experience includes:
Acting for the successful beneficiaries in AB v CD [2019] EWHC 2324, an unusual case in which the trustees of trusts surrendered their discretion to the court, resulting in an order that the trust funds be distributed entirely to the successful beneficiaries.
Acting for one of the respondents in an appeal to the Privy Council regarding the so-called ‘Black Swan’ jurisdiction in the BVI.
