Kelvin has over 20 years of experience in dispute resolution, representing clients at all levels of the Malaysian courts, including the High Court and Appellate Courts. He has extensive expertise in arbitration and adjudication, acting in commercial, civil, construction, and general corporate disputes.

Construction Law

Kelvin is highly experienced in construction law, advising on and acting in disputes involving buildings, infrastructure, utilities, O&G refineries, and large-scale solar projects. He has represented main contractors, specialist design-and-build contractors, subcontractors, and consultants in multi-million-ringgit arbitrations, adjudications, and injunctions.

Factories & Machinery Disputes

He has acted for fabricators, suppliers, and factory owners in disputes involving the design, fabrication, and installation of machinery, including motor control centres, curing chambers, and rice milling equipment.

Intellectual Property Disputes

Kelvin has represented clients in copyright and passing-off actions, including matters involving publications, FMCG products, and integrated revenue management solutions.

General Dispute Resolution

Kelvin also advises on and acts in various general commercial and corporate disputes, including shareholder disputes, sales of goods and services, tenancy and property matters, winding-up proceedings, fraud allegations, and banking and financial recovery actions.

Career

Kelvin Ng Chun Yee was admitted as an Advocate & Solicitor of the High Court of Malaya in 2005. He is the Managing Partner at Vin Cheng & Co, with over 20 years of experience in dispute resolution, construction law, and corporate matters. Kelvin is a fellow of the Chartered Institute of Arbitrators (FCIArb) and the Malaysia Institute of Arbitrators (FMIArb). He serves as a panel arbitrator under the Asian International Arbitration Centre and as a panel adjudicator under the Construction Industry Payment and Adjudication Act 2012. He has represented clients in arbitration, adjudication, and all levels of Malaysian courts.

Work Highlights

Kelvin Ng has acted in high-value construction disputes, representing main contractors and specialist design-and-build contractors in arbitrations and adjudications. His work includes a RM160 million arbitration in the RAPID Project steam cracker plant, a RM37 million dispute for the Ministry of Defence Automated Storage and Retrieval System, a RM25 million arbitration for a research and development building at the University of Technology Petronas, the Sungai Malacca Rehabilitation and Beautification Project, a RM86 million dispute over the Butik Botak Squatter Re-settlement scheme, and a RM28 million dispute involving excavation of rock material against government-linked companies.

In factories and machinery disputes, Kelvin has acted for fabricators, suppliers, and factory owners in matters involving the design, fabrication, and installation of equipment, including motor control centres, curing chambers, and rice milling machinery. In intellectual property, he acted for a solution provider in a RM7 million arbitration involving an integrated revenue management system for state agencies.

Kelvin’s general commercial and corporate experience covers disputes against OEM manufacturers for defective products, allegations of fraud against multinational conglomerates, and acting for several developers and business owners against DBKL before the Appeal Board under the Federal Territory (Planning) Act.
