Jay Nuttall is a nationally recognized first chair patent trial lawyer that obtains "superb results" and companies depend on "when the stakes are high." Clients attribute Jay's success to his quick thinking, effective cross-examination skills, and ability to articulate complex legal and technical issues. Clients state that he is "excellent," "excels in the courtroom," "prepares cases thoroughly with well-prepped witnesses and compelling exhibits," and is an "expert in patent trials." He is the former co-chair of Steptoe's IP Group and former Chicago office managing partner.
Some of his significant victories include securing a $170 million verdict where the jury awarded the full damages sought and found wilful infringement; a $40 million verdict where the jury found for his client on all issues at trial; trying a complex 11-patent case in which the client won on all issues, obtained an injunction and received attorneys' fees; obtaining a jury verdict of willful infringement and a $78 million judgment; and defeating a multi-patent infringement claim alleging more than $4 billion in accused sales. His substantial trial experience spans a range of technologies, including networking, software systems, telecommunications, medical devices, pharmaceuticals, electronic systems and methods, and chemical processes. Jay has successfully served as lead counsel on patent, trade secret, copyright, trademark, and other technology related matters.
Jay also frequently serves as lead counsel for both petitioners and patent owners in post grant review proceedings, including inter partes review (IPR). He recently successfully obtained institution of multiple inter partes reviews (IPRs) amid leadership changes at the PTAB, which have decreased institution rates from 70% down to 10%.
