Jana Magnuson works with individuals, couples and families to prepare solid and flexible wills, trusts, durable powers of attorney and health care directives. She also assists clients with specific objectives such as creating special needs trusts and tax shelter trusts; transferring business holdings and real estate; making gifts; structuring premarital agreements; and securing guardianships and conservatorships.

Jana particularly enjoys crafting settlement agreements and judicial solutions to fix ambiguous and other “problem” trusts to better achieve trust purposes, and working with parents and siblings to create trusts and limited liability companies for strong and flexible multi-generational ownership of family camps and cottages.

In addition to advising personal representatives and trustees on administration of Maine probate estates and trusts, Jana frequently represents nonresident estate executors in ancillary probate proceedings to transfer Maine real estate. She also advises trust companies and individual trustees with respect to trustee discretionary decisions and other trust actions, and nonprofit organizations on matters relating to their activities and tax-exempt status.

Jana has an active pro bono practice preparing estate plans for terminally ill hospice patients of limited means.
