James Lloyd is Deputy Head of the Mountford Chambers Regulatory Practice Group. He is regularly instructed to present fitness to practise and professional disciplinary proceedings on behalf of regulators, and also defends regulated professionals before disciplinary tribunals across a wide range of sectors, including healthcare regulation, education, architecture, inquests, inquiries, financial services, policing, sports, accountancy, transport, and pharmaceuticals.
He has acted in Serious Fraud Office (SFO) investigations into financial institutions and insider dealing, and advised multinational entities on SFO investigations concerning global trading arrangements. His experience includes past business reviews of financial institutions and COBS compliance, as well as ‘skilled person’ reviews under s.166 FSMA 2000 commissioned by the Financial Conduct Authority into alleged mis-selling of interest rate hedging products. He has also assisted in investigations into the mis-management of investment portfolios.
In Page & Ors v Financial Conduct Authority [2022] UKUT 124 (TCC), one of the largest Upper Tribunal cases in recent years, James acted as junior alone for four applicants. The case concerned the transfer of approximately 1,500 retail customer pensions worth over £60 million into unsuitable investments and addressed core issues of IFA duties, due diligence, honesty and integrity, and conflicts of interest.
