Career
Patrick Warfield is a partner located in the Nashville, Tennessee office of Burr & Forman LLP and is a member of the firm’s Creditors’ Rights & Bankruptcy service group. Patrick is also a member of the firm’s health care practice group. His practice focuses on out-of-court workouts and distressed transactions, bankruptcy, financially distressed businesses and loans, complex commercial litigation, landlord-tenant disputes, creditors’ rights matters, and other related insolvency issues.
Patrick has a depth of experience in solving problems throughout a multitude of industries, including health care, pharmaceutical, retail, manufacturing, and financial services. In representing clients, and in addition to providing legal advice, Patrick helps clients find, create, and salvage value even in the most difficult of circumstances. He assists clients in developing strategy and coming up with creative solutions and tactics to accomplish their end goals.
Patrick is routinely engaged by banks, financial institutions, secured and unsecured lenders, trade creditors, and secondary debt purchasers to assist them through the complex legal and regulatory landscapes. He is also hired by commercial landlords to represent them with distressed leases, bankrupt tenants, and complex eviction matters. In addition to the above, Patrick is routinely engaged by health care companies and health care REITs to advise them with respect to financially distressed situations.
In representing his clients, Patrick often: restructures troubled credit facilities and businesses; assists with the buying and selling of distressed assets, businesses, and commercial paper; structures distressed mergers and acquisitions; and represents clients in bankruptcy cases across the country, as well as debtor-creditor litigation in both state and federal courts. He often is engaged to advise and defend clients with respect to lender-liability lawsuits, fraud-related investigations and litigation, preference actions, and fraudulent transfer lawsuits.
Aside from the practice of law, Patrick is a proud Nashvillian and gives his time to various civic and non-profit endeavors, including the Legal Aid Society of Middle Tennessee and the Cumberlands and the Westminster School for Young Children.

Represented a secured lender in repackaging a multi-million dollar credit facility, preventing the borrower from filing bankruptcy.
Represented a commercial landlord in a complex shopping center tenant bankruptcy.
Successfully prosecuted and obtained a judgment in a multi-million dollar health care creditor-debtor dispute.
Obtained a temporary restraining order on a debtor's accounts preventing the dissipation of key assets. A favorable settlement was obtained after receiving the restraining order.
Represented numerous law professors in filing an amici brief before the Tennessee Supreme Court.
Defended and obtained a favorable settlement for a trade creditor in a preference action.
Represented a lender in a land dispute and obtained a full payoff of the loan.
Represented lead bank in the turnaround and sale of several multi-state ambulatory surgery centers.
Represented stalking horse bidder in the bankruptcy sale of a multi-million dollar mental health facility.
Represented the senior secured lender with respect to a troubled health care facility.
Repackaged the lease facility of a multi-state senior care facility.
