Represented Hebei RiseSun Real Estate Development Co., Ltd. against two individuals, an automobile parts company, and an industrial company in a case involving joint venture and joint real estate development contract dispute in the Higher People’s Court of Hebei Province, and obtained the outcome of the court’s second instance judgment dismissing all of the other party’s litigation claims. Assisted China National Chemical Engineering Group Corporation in second instance proceedings in the Higher People’s Court of Shaanxi Province involving a dispute with a mining construction company and an energy company over the addition and change of the executor’s execution objections, and successfully obtained a favorable outcome confirming the reversal of the decision not to impose additional penalties.【(2021) Shaanxi Civil Final 648】
Assisted CITS (Guangdong) Corporation Limited in the retrial proceedings of the cooperation contract/private loan dispute with a private enterprise before the Higher People’s Court of Guangdong Province, whereby the Court reversed its judgment and substantially reduced the private loan interest rate from 24% to 6%. 【(2020) Guangdong Civil Retrial 421】
Assisted China Travel Service Northwest Co., Ltd. in second instance proceedings at the Supreme People’s Court for a construction engineering contract dispute with a construction group and a tourism development company, involving piercing the corporate veil and shareholders’ defective capital contributions. The Court reversed the original judgment that held the client jointly and severally liable for the tourism development company’s outstanding payments to the construction group, thus successfully realizing the litigation objectives of the client. 【(2022) SPC Civil Final 116】
Assisted Hangzhou Hikvision Digital Technology Co., Ltd. in second instance proceedings at the Supreme People’s Court for the construction engineering contract dispute with Tangshan Caofeidian Development Investment Group Co., Ltd. and Hebei Baotong Data Technology Co., Ltd., and Baotong Data Technology Co., Ltd., and achieved the victory of the court’s dismissal of the other party’s appeal request. 【(2022) SPC Civil Final 22】
Represented the Fujian Branch of an insurance company against the Fuzhou Branch of a commercial bank, in an arbitration case before CIETAC, involving a dispute over insurance claims assignment contract, and secured a complete victory that set a new precedent, with the other party returning approximately RMB 15 million of the insurance recovery amount and recovery costs to the client; and in the subsequent proceeding initiated by the other party to set aside the arbitration award, successfully obtained a ruling of dismissal of the application.
Represented a securities company against several investors in an arbitration case before the Beijing Arbitration Commission involving fund contract disputes, and obtained a favorable outcome in which the arbitral tribunal rejected all of the other party’s arbitration requests.
Represented a trust company against a number of Evergrande-affiliated enterprises in a trust loan and guarantee contract dispute before the Beijing Arbitration Commission, achieving a favorable outcome in which the arbitration requests were largely upheld.
Represented a Shenzhen equity investment partnership against a Shenzhen innovation investment center and a Beijing venture capital center in an investment contract dispute before the Beijing Arbitration Commission, assisting the client, as the original shareholder, in reducing the amount payable to investors under repurchase obligations by nearly 30%. This case involves the issue of performance-based agreements in private equity fund investments abroad.
Represented a Chinese state-owned listed company against a Beijing automobile company and a Beijing joint stock company before the Beijing Arbitration Commission involving a loan and guarantee contract dispute, and obtaining a victory in which all arbitration requests were upheld. The disputed amount exceeded RMB 1.8 billion.
Represented a fund management company against a fund company in a bond repurchase contract dispute valued at RMB 80 million before CIETAC, successfully preserving the other party’s property valued at approximately RMB 62 million, and assisting the client in successfully resolving the dispute through mediation.
Represented an asset management company against a real estate company before CIETAC in a dispute over the transfer and repurchase contract of equity gain rights and a mortgage contract and obtained a favorable ruling. Despite the lack of mortgage registration for the proposed mortgaged properties and construction-in-progress, we successfully assisted the client in securing the initial seizure, laying the groundwork for the subsequent enforcement of nearly RMB 600 million in adjudicated claims.
Represented a private investment fund managed by a trust company against another private investment fund before the Shenzhen International Arbitration Court in an arbitration case involving bond repurchase contract dispute with a disputed amount of RMB 235 million, and successfully achieved a victory in which the arbitral tribunal upheld all arbitration requests of the client, and assisted the client in recovering over RMB 220 million through the execution procedure.
