Hilary Tyson’s practice as a member of the Real Estate Group focuses on commercial real estate and related business transactions. She joined the firm and returned to Houston after practicing in the Dallas area for more than 11 years. She has over 20 years experience in the practice of real estate law representing developers, landlords and tenants in residential, office, industrial, retail, restaurant and mixed-use spaces.
She represents developers, regional and national homebuilders and equity investors in a wide range of real estate related transactions including land acquisition and dispositions, residential subdivision and master planned community development, urban infill and adaptive re-use, industrial development, construction and leasing, financing, entity formation, and multi-family, shopping center, retail, office and mixed-use development and leasing. Her experience includes drafting and negotiation of contracts, development agreements, maintenance agreements, Chapter 380 agreements, special assessment and utility district development and reimbursement agreements, licensing agreements, construction loan agreements and other financing documents, and agreements in connection with the acquisition, financing, development and operation of real estate, including ground leases, restaurant, retail and office leases, industrial leases, declarations of covenants, conditions and restrictions for commercial, residential and mixed-use projects, and condominium restrictions and related association governance documents, and entity formation and governance documents. Hilary is licensed to practice law in Texas and Oklahoma, and serves clients operating in all market areas of Texas and Oklahoma.
Hilary’s interest in real estate development began in college working for homebuilders and architectural firms. During law school she participated in the Community Development Legal Clinic representing Chicago-area not-for profit and community organizations in a variety of business and real estate matters, including negotiation of leases, land acquisition, entity formation and applying for tax exempt status. Hilary continues her interest in real estate and serving the community by her active participation and work with various community and non-profit organizations.
Hilary serves on the ULI Houston Urban Plan Committee and Co-Chair and ULI Houston’s Development of Distinction Committee. Hilary also serves of the Properties Committee of the Girl Scouts San Jacinto Council and CREW Houston’s Outreach Committee and Mentoring and Leadership Committee. Hilary is also Co-Chair of the Houston Bar Association’s AIDS Outreach Committee. Hilary also actively serves on BoyarMiller’s LABB initiative.
