For 30+ years, Eric has represented clients in complex, high-stakes antitrust litigation at trial and on appeal in federal district and appellate courts throughout the United States. At Freshfields, his practice focuses on antitrust litigation and regulatory matters. Eric has successfully defended clients in the entire range of antitrust issues, from Section 2 monopolization challenges to Section 1 cartel cases to Section 7 merger challenges. He has represented clients in civil and criminal investigations, enforcement actions, and other regulatory proceedings both in the US and in Europe. In addition, he has handled second phase merger reviews on both sides of the Atlantic.
Career
Eric has led and prevailed in many of the country’s most high-profile antitrust matters, including victories at trial both as a DOJ prosecutor and on the defense side. From 2015 through 2017, Eric served as the Director of Litigation for the DOJ’s Antitrust Division, leading the Division’s litigators in the successful challenges to the Aetna/Humana, Anthem/Cigna, and Energy Solutions/WCS mergers. Upon returning to private practice, he then defeated the federal government in a merger challenge in FTC v. RAG Stiftung, marking only the second time the FTC had lost a litigated merger challenge since 2011. Since then, Eric has successfully defended clients in civil and criminal antitrust investigations achieving favorable results for his clients, from voluntary dismissals and early settlements, to victories at all stages of litigation, including at trial and on appeal. His practices spans a wide range of industries, including high tech, healthcare, chemicals, industrials, agriculture and foods, building materials, advertising, sports, and many more.
