Career

David King is a partner in Herrick's Litigation Department. David has broad complex commercial litigation experience. He has significant real estate and construction litigation experience. He also represents lenders and other parties in complex partnership and joint venture disputes, and in foreclosure and restructuring matters. He has also prosecuted and defended significant malpractice cases, including legal and accounting malpractice matters, and successfully defended multiple class actions. David is an experienced insurance and reinsurance litigator, having represented both insureds and insurance companies in coverage matters and reinsurance claims.

David practices in state and federal courts and has tried over a dozen matters to verdict before courts and arbitration panels. He is recognized as an AV Preeminent-rated attorney under the Martindale-Hubbell Peer Review Ratings.

Significant matters include the representation of the Chapter 7 bankruptcy trustee of Winstar Communications in an adversary proceeding in Delaware Bankruptcy Court. David co-chaired the three-month bench trial, recovering a judgment worth over $300 million on preference, equitable subordination and breach of contract claims. David also successfully defended appeals of the judgment to the District Court of Delaware and the United States Court of Appeals for the Third Circuit, where the Court affirmed the Bankruptcy Court in all relevant aspects and left the judgment fully intact.

Other recent matters include the successful defense of Bridgestone Americas in the Third Circuit’s landmark Marcus class action decision, his representation of a consumer products manufacturer post trial, where he secured reversal of a multi-million dollar jury verdict and a new trial in a published New Jersey Appellate Division opinion, and his successful representation of a registered investment advisor in a multi-million dollar key-man disability policy coverage action. Most recently, he prosecuted through trial auditing malpractice claims valued at approximately $90 million on behalf of a group of hedge fund investors against a prominent international accounting firm, and he is representing the Condominium Board of a Billionaire’s Row property in construction defect litigation claims valued in excess of $100 million.
