Career
David Gopstein is a seasoned trial lawyer and former federal prosecutor whose practice focuses on white collar defense, regulatory enforcement, internal investigations, and complex commercial litigation.
David represents public and private companies, asset management firms, professional sports organizations and teams, and individuals in a broad range of criminal and civil matters and internal investigations. He has secured exceptional results for clients, including numerous declinations and favorable resolutions in government investigations, and favorable resolutions in commercial disputes. David has been recognized by publications such as Benchmark Litigation, Crain’s New York, Legal 500 US, and Lawdragon, with clients describing him to Benchmark as “an elite writer, a gifted oralist, and a better person,” “especially skilled at trials and oral arguments,” and “smart, creative, and responsive” with a “client centered” approach.
David currently serves on the Board of Directors of the Office of the Appellate Defender and is a member of the Criminal Justice Act Panel in the Eastern District of New York, where he represents indigent criminal defendants in federal court.
Prior to joining the firm, David served as Deputy Chief of the Business & Securities Fraud Section of the U.S. Attorney’s Office for the Eastern District of New York. Over his seven years as an Assistant U.S. Attorney (AUSA), David also served at various points as the Healthcare Fraud Coordinator, Environmental Crimes Coordinator, and Computer Hacking and Intellectual Property Coordinator. David conducted numerous jury trials and led and supervised a wide range of investigations and prosecutions involving fraud and market manipulation, money laundering and the Bank Secrecy Act, digital assets and cybercrime, and foreign bribery and the Foreign Corrupt Practices Act (FCPA). As an AUSA, David worked closely with other divisions within the Department of Justice (DOJ) as well as other federal regulators including the Securities and Exchange Commission (SEC), Commodity Futures Trading Commission (CFTC), and Office of the Comptroller of the Currency (OCC). David also briefed and argued numerous appeals before the Second Circuit Court of Appeals. David twice received the Federal Law Enforcement Foundation’s Prosecutor of the Year award, as well as the Internal Revenue Service (IRS)’s Deputy Commissioner award and the Federal Drug Agents Foundation True American Hero award.
Prior to joining the U.S. Attorney’s Office, David clerked for the Honorable Naomi Reice Buchwald of the U.S. District Court for the Southern District of New York and worked at Debevoise & Plimpton.
David received his J.D. from Yale Law School, where he was a senior editor of the Yale Law & Policy Review. He received his A.B., summa cum laude, from Princeton University.
