Some of his biggest victories are quietly avoiding a DOJ or SEC case – in areas as diverse as price fixing, fraud, bribery, tax, environmental, FCPA, trade sanctions, health care, false statement, and others. He is also known for his court cases, some of which are listed below.
Career
David clerked for two federal judges – U.S. District Judge Harry Lee Hudspeth in El Paso, Texas and U.S. Fifth Circuit Judge Jerre S. Williams – and served as an Assistant Federal Public Defender in Houston. Before starting his current firm, David practiced at Foreman DeGeurin Nugent & Gerger and opened the Houston office of the Quinn Emanuel firm.
Experience
Cases Include:
Defending the CFO of Enron in his criminal and SEC matters following the company’s collapse;
Defending the Boeing Pilot who was indicted – and exonerated – over the 737MAX tragedy;
Defending the BP rig supervisor against charges that he caused the Deepwater Horizon blowout and oil spill – ending in dismissal and acquittal on all charges;
Acquittal in the Marine Hose Price Fixing Cartel Trial in Ft. Lauderdale, Florida;
Reversal on appeal of the “Ahmad” Clean Water Act case – establishing that water pollution is not a strict liability crime;
Reversal on appeal of the “Olis” securities fraud sentence – establishing that “loss causation” applies in criminal cases;
Dismissal of all charges against an immigration attorney who was charged federally with obstruction of justice – just for doing her job;
Winning “compassionate release” for inmates with dire medical needs or other extraordinary grounds for relief;
And others.
