Partner Daniel Gottlieb counsels a wide range of health care industry clients, including health care providers, health plans, health information technology (IT) vendors and life sciences companies. He represents clients on privacy and data protection, reimbursement, software licensing and other health IT acquisitions, fraud and abuse, and other health care regulatory and transactional matters.
Daniel counsels regarding compliance with the Health Insurance Portability and Accountability Act of 1996 (HIPAA), the European General Data Protection Regulation (GDPR), California Consumer Privacy Act, the Telephone Consumer Protection Act, CAN-SPAM, and other federal and state privacy, security and breach notification laws. He drafts comprehensive health information privacy, security and incident response compliance programs for health care industry clients, including those with cloud-based systems. Regularly advises clients regarding response to cyberattacks and other security breaches and defends subsequent investigations by the Department of Health and Human Services Office for Civil Rights and state regulators. Advises health care industry clients on software licenses and other agreements for the acquisition electronic health record (EHR) systems, enterprise data warehouses and other missing critical health IT and health content.
