Andrea McEwan

Andrea McEwan is a Partner at WeirFoulds LLP and Co-Chair of the firm's Wills, Trusts & Estates Practice Group. She practises exclusively in the areas of estates, trusts, fiduciary, and capacity litigation and is recognized as a leading practitioner in estate and trust disputes.

Andrea represents beneficiaries, trustees, executors, attorneys under powers of attorney, incapable persons, and family members in a broad range of contentious estate, trust, and capacity matters. Her practice encompasses passing of estate, attorney, guardian and fiduciary accounts, probate applications, guardianship proceedings, power of attorney disputes, end-of-life and treatment decisions, and other elder law matters.

Throughout her career, Andrea has appeared before all levels of court in Ontario and has acted on complex motions, applications, trials, and appeals involving estates, trusts, fiduciary obligations, and capacity-related issues. She has extensive experience resolving high-conflict disputes through litigation, mediation, and other alternative dispute resolution processes.

Andrea regularly acts in sophisticated estate, trust, fiduciary, and capacity disputes involving contested wills, guardianships, powers of attorney, passings of accounts, beneficiary designation disputes, and high-value estate administrations. Her experience includes litigation arising from family business succession, multi-million-dollar estates, charitable bequests, and complex capacity matters. She has also acted in significant commercial and insolvency proceedings, including matters arising from the Nortel Networks restructuring.

Andrea is repeatedly recognized in the Canadian Legal Lexpert Directory as a leading lawyer in Estate & Personal Tax Planning – Estate Litigation and in Best Lawyers in Canada for Trusts and Estates. In 2026, she was selected for inclusion in the Private Client Global Elite Directory, recognizing her standing among leading private wealth practitioners.

Outside the firm, Andrea is actively involved in the legal profession. She serves as a Director of The Advocates' Society and previously served as Vice Chair of its Estates Litigation Practice Group. Andrea holds the Trust and Estate Practitioner (TEP) designation through STEP Canada and volunteers her time with the Barbra Schlifer Commemorative Clinic.
