Work Highlights
Recovery of Bond - Recovered USD 6 million performance bond for a leading construction company in litigation against a local bank before the Bahrain Chamber for Dispute Resolution (BCDR).
Dispute with Nominee - The client, a multinational oilfield services company, engaged in a verbal agreement with a nominee for the establishment of its Bahraini subsidiary. According to the arrangement, the nominee was supposed to transfer all interests in the Bahraini subsidiary to our client upon its establishment. However, the nominee reneged on the agreement, asserting ownership of the Bahraini subsidiary. Despite the absence of clear documentation and relying heavily on circumstantial evidence, the court ruled in favor of our client. As a result, the court ordered the payment of damages, including compensation for the value of the Bahraini subsidiary and loss of profits.
Arbitration - Represented a leading gas and oil company in an ICC arbitration under Bahraini law against its shareholders.
Termination of distributorship - Secured a favorable outcome for a luxury vehicle manufacturer in litigation filed by a local agent for alleged wrongful termination of distributorship, resulting in a final judgment in the client's favor.
