Alok Jain is a Partner in the Arbitration and Dispute Resolution Practice of Quillon Partners.
He has represented and advised domestic and international clientele in negotiations, mediations, international commercial & domestic arbitrations and court litigation. He has worked across sectors including oil and gas, infrastructure and construction, ports, energy, metals and mining, chemicals, electronic and consumer goods, information technology, heavy machinery and finance. Clients have often remarked that Alok demonstrates a keenness to understand the minutest of technical aspects of their businesses before offering any solutions.
Alok has extensive experience in ad-hoc and institutional arbitration, including arbitrations under the Rules of ICC, LCIA, SIAC, GAFTA, BSE and NSE. He is also adept at advising clients on pre-dispute management and has often succeeded in obtaining settlements that offer business continuity.
Alok has been elected as the ICC Young Arbitration and ADR forum representative for South Asia by ICC Arbitration.
Work Highlights
Representing an Italian Oil & Gas contractor before the courts in India in defending a legal action brought by a Russian company seeking to enforce a Euro 2 billion judgment of the Moscow court. The Moscow judgment was issued under Article 248 of the Russian civil procedure code which enables it to exercise jurisdiction despite of foriegn seated arbitrartion.
Representing two of the world’s largest international dredging contractors in their disputes against one of India’s largest government owned ports. The disputes are across multiple fora – arbitration, civil suit and criminal proceedings.
Representing an Italian engineering company in defending a challenge to an arbitral award obtained against one of India’s foremost oil refining companies.
Successfully represented a Malaysian construction company in an arbitration pertaining to offshore construction works against an upstream Indian oil and gas exploration company. Currently representing the Malaysian contractor in the courts in enforcement and challenge proceedings wherein the Indian company has been ordered to deposit the entire award amount in court.
Successfully represented India’s largest construction company in an ICC arbitration against a state public sector undertaking in relation to an EPC contract involving the construction of a private railway line.
Successfully represented a major EPC contractor in an arbitration involving disputes pertaining to construction of a bus terminal in Odisha.
Successfully represented an Indian offshore construction contractor in an arbitration between it and a subcontractor pertaining to termination of a sub-contract for subsea work in Iran.
Successfully represented a financial services company in an arbitration against a debtor/guarantor in relation to pledged shares.
Successfully represented a European majority shareholder in its disputes against an Indian minority shareholder on breaches of the non-compete clause in the JV agreement.
Successfully represented an EPC contractor in an arbitration against one of India’s largest shipyards pertaining to the expansion of the shipyard’s facilities.
Successfully represented India’s largest listed construction company in a dispute with the concessioning authority in relation to the roads sector.
Advised one of the world’s largest port operators in their disputes with an Indian port authority at the stage of development of the port on issues of price escalation and force majeure.
Successfully represented one group in a family dispute pertaining to a large a real-estate conglomerate in an LCIA arbitration in India.
