He also represents clients in disputes involving the sale and purchase of businesses.    

Recent engagements include representing the owner of multifamily residential properties in multi-district litigation alleging that RealPage, property owners, and management companies engaged in price fixing in violation of antitrust laws; defending a correctional institution service company in a $30 million trade secret arbitration; and representing the owner of an aerospace and defense contractor in a partnership dispute relating to ownership interests.

  

Drawing on their shared Big Law backgrounds, he and partner Clayton Bailey launched the litigation boutique Bailey Brauer in 2013 with a goal of providing clients with the same level of service expected of large firms, but in a more agile and personalized fashion. That focus on client service has earned Alex and the firm the trust of business leaders throughout Texas and across the nation. While Alex has assisted several clients with disputes involving the sales and purchases of businesses, clients call on Alex to resolve various controversies ranging from allegations of fraud and deceptive practices in commercial transactions to breaches of fiduciary duties and obligations relating to non-compete agreements. Alex is a member of various bar associations and committees and has served on the Dallas Bar Association Judiciary Committee and Fee Disputes Committee. Alex graduated cum laude from Florida State University before earning his law degree at the Georgetown University Law Center, where he served as executive editor for the Georgetown Journal of Legal Ethics.

FPEI HEPS AUSTX LLC v. Ariah Rastegar, Cause No. DC-24-11010, 134th District Court for Dallas County, Texas. Obtained $5.3 million judgment relating to commercial real estate investment.

MQ Prosper N., LLC v. Coulter, No. 05-20-00800-CV, 2022 WL 17580198 (Tex. App.—Dallas Dec. 12, 2022, no pet. h.). Obtained appellate court ruling affirming judgment in client’s favor after a week-long bench trial.

Sudharani Dikkala, M.D. v. NTKC-DFW, PLLC, Cause No. 017-330261-21, 17th District Court for Tarrant County, Texas. Trial verdict in client’s favor against allegations that plaintiff physician owned 20% of nephrology practice.

North Texas Opportunity Fund L.P. v. Hammerman & Gainer Intern., Inc., No. 3:14-cv-1906, 2015 WL 3461035 (N.D. Tex. Apr. 22, 2015). Successfully resolved dispute involving claims of fraud relating to multimillion-dollar purchase of business.

Chronos Solutions, LLC f/k/a Matt Martin Real Estate Management LLC v. Caliber Home Loans, Inc., et al., Cause No. DC-16-13301, 95th District Court for Dallas County, Texas. Successfully resolved dispute involving multimillion-dollar breach of contract claims relating to real estate transactions.

Marcus & Millichap Real Estate Investment Services, Inc. and Marcus & Millichap Real Estate Investment Services of Nevada, Inc. v. Jason Vitorino and J Vitorino Enterprises, LLC, No. 3:15-cv-03768, Northern District of Texas—Dallas Division. Successfully resolved dispute alleging tortious interference with contractual relations relating to commercial real estate transactions.

The Lakes of Millbrook Apartments, L.L.C. v. Transcontinental Realty Investors, Inc. and Silver Star Title d/b/a Sendera Title, Cause No. CC-16-05931-A, County Court at Law No. 1 for Dallas County, Texas. Successfully resolved dispute involving sale of $22 million Alabama apartment complex.

Brian Reed Kainer, individually and on behalf of K Construction, LLC v. James Frank Killingsworth, Jimmy Allen Brown, and Evan Jones, Case No. 219-02832-2019, 219th District Court for Collin County, Texas. Successfully resolved dispute alleging fraud and breach of fiduciaries duties relating to ownership in utilities subcontractor.

NQ Mobile US, Inc. v. Titans Group Empresa De Participacao Em Negocios Ltda, ICDR Case No. 01-15-0005-8959, International Centre for Dispute Resolution. Obtained $5 million judgment for mobile phone software developer in international arbitration against Brazilian anti-virus developer in contractual dispute.

Leland Lou, M.D., et al. v. Speed of Light X-Ray, LLC, et al., Cause No. 2017524697, 99th District Court for Lubbock County, Texas. Successfully resolved dispute alleging tortious interference with contract and theft of trade secrets relating to competing mobile x-ray businesses.

Wheeler v. Pilgrim’s Pride Corp., 591 F.3d 355 (5th Cir. 2009) (en banc). Secured “tidal wave” opinion and cemented the law protecting the agribusiness industry.

City of Clinton, Ark. v. Pilgrim’s Pride Corp., 632 F.3d 148 (5th Cir. 2010). Preserved favorable judgment after defeating a city’s claims seeking in excess of $28 million in damages.

Wheeler v. Pilgrim’s Pride Corp., 246 F.R.D. 532 (E.D. Tex. 2007). Won complete victory in a class-certification attempt as part of an antitrust conspiracy case against the nation’s two largest poultry companies.

Do v. Pilgrim’s Pride Corp., 512 F. Supp. 2d 764 (E.D. Tex. 2007). Secured successful summary judgment against RICO claims seeking millions of dollars in damages.
