Alastair McKendrick is a litigator with over 16 years’ experience of court work and is recognised by the Law Society of Scotland as an Accredited Specialist in Housing and Residential Tenancy Law. He is head of the Litigation team. He was promoted to Partner in 2018 and manages a wide variety of cases including construction, contract and property disputes, together with all aspects of housing law for Registered Social Landlords (RSLs), letting agents and private landlords.

Dispute Resolution – He handles all litigation matters, which includes pursuing and defending civil litigation, and actions for damages (including claims for compensation raised against clients). Alastair appears in Sheriff Courts throughout Scotland handling a range of disputes, including actions of payment, damages and interdict. He also acts as a Court of Session agent for a number of firms across Scotland.

Involved in arbitration and adjudication proceedings for clients, he successfully acted for a client in a mediation concerning a long-running construction dispute with the client’s design team and contractor. Terms of settlement were agreed without the client having to pursue a lengthy and costly litigation.

Housing Management, Repossessions and Factoring – Alastair has conducted a vast array of cases for housing providers handling a range of both contentious and non-contentious housing management issues, including repossession cases for rent arrears and anti-social behaviour.

He advises RSL factors and other factoring organisation on all contentious matters, including debt recovery. He has represented factors in both the Sheriff Court and at hearings before the First-tier Tribunal (Housing and Property Chamber).

Data Protection – Alastair advises clients in relation to a variety of data protection issues, including the review of policies and procedures and contentious matters, including breaches. He works with our RSL client providing a “back-room” Data Protection Officer’s service, assisting the named DPO with Data Protection compliance. He handles all contentious Data Protection claims, including breaches.
