• Representing the Federal Housing Finance Agency, as conservator for Fannie Mae and Freddie Mac, in obtaining from the Second Circuit a unanimous affirmance of an $806 million judgment against Nomura and RBS in a landmark residential mortgage-backed securities litigation.
• Representing Manhattan District Attorney Cyrus R. Vance, Jr. in a matter before the U.S. Supreme Court concerning whether the Constitution provides a President with immunity from criminal investigation for private, unofficial conduct.

Bankruptcy & Insolvency:

• Representing a worldwide management consulting firm against claims by Jay Alix, founder of consulting firm AlixPartners, challenging Chapter 11 disclosures under Rule 2014 in bankruptcy courts in the Southern District of New York, the Southern District of Texas, the Eastern District of Virginia, and the District of Delaware.
• Representing foreign representatives of several funds in liquidation abroad in Chapter 15 proceedings in Bankruptcy Court for the Southern District of New York, and before the U.S. District Court on appeal, asserting foreign avoidance, common law, and breach of contract claims, seeking to recover about $6 billion dollars in redemption payments from hundreds of entities arising out of the Madoff scheme.

Complex Commercial Disputes:

• Representing a web portal and online service provider, defending two separate putative class action lawsuits seeking statutory damages in excess of $650 million under the Electronic Communications Privacy Act relating to a data breach that was referred to at the time as the “Exxon Valdez” of data breaches.
• Representing crypto-asset investors in 12 class actions in the Southern District of New York against four of the world’s major crypto-asset exchanges and seven digital token issuers who allegedly offered and sold billions of dollars of unregistered digital tokens and other financial instruments to investors in violation of federal and state securities laws.

Securities & Structured Finance:

• Representing U.S. Bank, as trustee, in an RMBS putback action against UBS Real Estate Securities, for losses suffered by three UBS-sponsored RMBS trusts. The case was the first RMBS trustee putback action to go to trial, and the settlement—an unprecedented $850 million recovery—constitutes the largest recovery ever achieved in such a case.
• Representing a financial services holding company as plaintiff in an action seeking recovery of more than $2 billion in damages from Countrywide Financial (and its parent, Bank of America) for misconduct that played a substantial role in causing the global financial crisis of 2008.
