THE FIRM:Sampaio Ferraz Advogados has a vast experience and recognized expertise in administrative procedures before the Brazilian Antitrust Agency (CADE), being one of the first specialized antitrust boutiques in Brazil. Since its foundation, the firm has been working in some of the country´s most complex and paradigmatic cases.

The law firm was founded by professor Tercio Sampaio Ferraz Junior, who has an outstanding academic record and is a professor in some of the main Universities in the country, being one of the most experienced and well-known lawyers in Brazil. Professor Tercio has been working together with his partner Thiago Francisco de Brito building a firm which has a reputation of highly technical expertise and which is focused on profoundly understanding the client´s business, market and requirements.

MAIN AREAS OF PRACTICE:

Antitrust/Competition:The firm main area of practice is Competition/Antitrust, in which SFA advises clients on strategic matters related to the Brazilian antitrust law, including, but not limited to: (i) the representation of companies in submitting requests for approval of mergers and acquisitions or oppositions to transactions; (ii) representing clients in investigations of conducts by CADE, both cartels and unilateral conduts (exclusivitiy, sham litigation, commercial policy, tying and others); (iii) supporting clients in structuring corporate transactions and business arrangements; (iv) drafting proposals and negotiating leniency agreements, cease and desist commitments and agreements in the scope of a merger procedure before CADE; (v) preventive assistance and legal consulting work, preparing and reviewing internal commercial policies and procedures for companies; (vi) risk assessment of corporate contracts in what pertains to Antitrust Law, and (vii) defense in legal suits arising from administrative decisions by CADE, including but not limited to annulment actions and claims for damages.

SFA has represented many clients from several markets and industries, including construction and infrastructure, food industry, media/technology, and regulated sectors.
