Rose LLP was formed by eight 'Big Law' litigation partners with a view to providing the highest calibre of legal representation, but outside the conflicts of interest inherent in a full-service law firm. They have been successful in prosecuting and defending claims for significant players in the oil and gas, construction, electricity, financial services and manufacturing industries across Canada, including leading representations in the Supreme Court of Canada’s Securities Regulator references on behalf of the Attorney General of Alberta, multiple billion-dollar disputes arising from oil and gas facilities transactions and pipeline development, major loss casualty insurance claims and precedent-setting litigation involving rights of first refusal and oil and gas leases, and mining development in the Canadian Arctic.

Energy & Construction:
Located in Calgary, Canada’s energy capital, the firm’s busy construction practice led by partners Lowell A. Westersund, KC, Robert J. Simpson, KC, Phillip J. Scheibel, KC, Andrew Wilkinson and Peter Vetsch offer integrated project counsel from inception to claims resolution. This includes the front-end structuring, drafting, negotiation, implementation and administration of construction contracts, as well as related construction performance litigation on behalf of some of the largest international engineering firms and energy companies undertaking extraction, processing and transportation projects in the Alberta oil sands, Western Canada’s most globally significant energy resource. These projects — one in the $10 billion range — have included open pit mines, upgraders, pipelines, steam-assisted gravity drainage facilities, primary and secondary processing facilities, roads, aerodromes and worker camps, as well as the development of coastal LNG export facilities and integrated petrochemical facilities. The firm’s mediation and litigation of large dollar, high-stakes disputes arising from construction performance have included contract interpretation issues, liens, bonds, productivity, delay, extra work and cost over-run claims.

International Corruption, Fraud & Asset Recovery:
Led by Matthew R. Lindsay KC, Rose’s niche practice in this area allows it to unravel complex and secretive multi-jurisdictional financial frauds and to locate, freeze and recover misappropriated assets, both through the skills of the firm’s attorneys and their seamless teamwork with FraudNet’s global, multi-jurisdictional experts. Rose lawyers have counselled a Canadian insurer in Trinidad proceedings alleging procurement fraud in airport construction, and served as trial counsel to a public resource company in a year-long trial and related appeals involving rights of first refusal and commercial fraud. They have obtained, defended and administered preservation orders over $100 million of Alberta commercial properties for an interim receiver in a worldwide, multi-jurisdictional asset recovery plan. Other international recovery work has included counseling Canadian financial institutions and energy industry clients on multi-jurisdictional fraud asset recovery plans, bills of exchange disputes, UCP 600 disputes, defense of knowing assistance claims, and Internet and website fraud cases.
