OCAMPO’s insurance and reinsurance practice represents clients in all aspects of insurance and reinsurance transactions. Transactions range from the inception of insurance contracts and reinsurance treaties, to coverage analysis and dispute resolution and litigation of this matters, and to regulatory matters. The firm's insurance and reinsurance practice has a wide range of clients from insurance and reinsurance companies to energy industries with risk administration and insurance matters needs. Recently OCAMPO has participated in energy and financial lines claims, for a combined amount of 600+ MUSD.
In March 2018, OCAMPO joined Global Insurance Law Connect, a formal network of insurance law firms that delivers the right advisers in the right places and in the right way around the world. OCAMPO is in charge of Mexico and is responsible for developing the Central America region.
This practice started 30+ years ago with the litigation of corporate matters, particularly disputes among shareholders. Since then this practice comprises a wide range of services, from incorporation to dissolution of corporations and bankruptcy. The practice currently is helping several insurance and surety companies and insurance brokers to implement corporate governance and other new regulations provided in the new law.
This practice is highly extensive and dates back to the mid-1980s when Afianzadora Insurgentes consulted OCAMPO regarding several important lawsuits.
Litigation & Dispute Resolution:
Litigation is OCAMPO’s most highly developed practice as it is where OCAMPO’s roots lie and have been continuously practiced since. OCAMPO looks to advise its clients in the prevention of risks and controversies in civil and commercial litigation, whether through arbitration or the courts; however, the team is prepared to protect clients’ rights and interests in the case of a lawsuit. OCAMPO’s experience throughout the years has afforded the firm the aptitude to intervene in all types of controversies, representing both the plaintiff as well as the defendant before Federal and State Courts, or if applicable, before arbitration tribunals. Litigation permeates throughout all the areas of the firm which allows it to continuously maintain a preventative vision in the analysis of other commercial or financial operations, providing opinions that tend to look for the best position and greatest protection of the firm’s client in contract performance and to respond to potential controversies. The firm represents its clients in all types of lawsuits, whether as plaintiff or defendant, such as: ordinary commercial or civil proceedings, bankruptcy proceedings, liability and Amparo pleads.
The IP practice covers the litigation, prosecution, registration and further handling of trademarks, patents, domain names, copyrights and other types of intellectual property rights granted under the Mexican Industrial Property law, as well as representing plaintiffs and defendants all phases of intellectual property counselling and litigation, including the licensing, sale, acquisition and secured financing of intellectual property rights. In addition, the firm represents a significant number of clients with the handling and prosecution of intellectual property rights within other countries in North, Central and South America, The Caribbean, Europe and Asia, by coordinating specialised local firms.
