Entertainment Litigation: 

■ Represents Justin Raisen, Jeremiah Raisen, and Justin “Yves” Rothman in a countersuit over Lizzo’s breakout song “Truth Hurts,” which alleges that the songwriters are co-authors of the critically acclaimed hit

■ Represents Frank Darabont, the creator and executive producer of zombie apocalypse series ‘The Walking Dead,’ and leading talent agency CAA, in profit participation litigation against AMC. The case is set for trial this year

■ Represented legendary “Fast and the Furious” franchise producer Neal Moritz in his dispute with Universal over the production of “Hobbs and Shaw.” The suit alleged breach of oral contract and promissory fraud over Mr. Moritz’s improper removal from the spinoff’s production. KWIKA successfully defeated Universal’s motion to compel arbitration, which allowed Mr. Moritz to publicly tell his account of how Universal has treated him in connection with the uber-successful franchise he helped build for the studio. Shortly after, all claims were settled and the matter was successfully resolved.

■ Represents reality television content producer Kinetic Content in a series of arbitrations brought against show participants who have violated the confidentiality provisions of their participant agreements to reveal the outcomes of the popular television show “Married at First Sight.”

■ Represented executive producer, Wark Entertainment Inc. f/s/o Barry Josephson, in a lawsuit against various Fox entities regarding profits from the hit series ‘Bones’, resulting in an arbitration award of $179 million

■ Represented business management firm The Management Group (TMG) in defense of a lawsuit brought by former client Johnny Depp over the handling of his finances, which included TMG’s cross-complaint for damages against Depp

■ Represented actress, singer, and fashion designer Jessica Simpson, along with her parents and her corporation, who were sued for breach of an alleged finder’s fee agreement in connection with the nine-figure sale of her company

■ Represented famed music group The Carpenters in royalty lawsuit against Universal Music Group (UMG) concerning streaming and online music distribution

■ Successfully and privately represented a number of film, television and music figures against unsubstantiated #MeToo claims

Intellectual Property Litigation: 

■ Represents Estate of Michael Jackson in numerous matters, including its litigation against HBO over the controversial “Leaving Neverland” documentary, and its copyright infringement suit based on Disney and ABC’s use of dozens of copyrighted works in a television program without permission

■ Represented Prince Harry, The Duke of Sussex, and Meghan, The Duchess of Sussex, in a complaint for invasion of privacy against unnamed paparazzi and media outlets who, in violation of California law, took photographs of their young son Archie playing in their private yard. After discovery involving the biggest celebrity news agencies to determine the source of the photos, it was determined the photos were taken and shopped by X17 Agency, one of Hollywood’s biggest paparazzi agencies. A settlement agreement was reached, with X17 offering an apology and agreeing to pay a portion of the family’s attorneys’ fees, and to turn over the photos to the family, destroy any copies in its possession, and never again traffic in any photos of the couple or their son taken by similar means.

■ Represents Mattel, Inc. in multiple IP matters, including product clearances, a lawsuit against writer claiming copyright ownership of Masters of the Universe toy brand, defense of trademark opposition proceeding brought by Universal Music Group concerning ‘Motown Metal’ line of Hot Wheels cars, and defense of claims for violation of publicity rights and idea submission

■ Represented a Live Nation Entertainment subsidiary in defense of a trademark lawsuit

■ Represented Roland Corporation in numerous matters involving protection of Roland’s copyrights and trademarks, including case of first impression establishing copyright protection for sound recordings contained in Roland’s keyboards, and prosecuting and defending claims of patent infringement in courts around the country

■ Represents Kim, Kourtney and Khloe Kardashian in numerous matters, including in related state and federal actions and in an arbitration against a hedge fund and its subsidiary over the operation of a cosmetics company, resulting in an $11 million arbitration award for the sisters; in connection with various matters involving the Federal Trade Commission in Washington D.C. and social media use; and in a right of publicity and trademark action against a fast fashion company that resulted in a $2.7 million judgment
