Jones Fortuna specializes in environmental and natural resources law and litigation. The firm has the leading water practice in Georgia. Jones Fortuna is also the only firm in the Nation with significant experience concerning the water supply program of the U.S. Army Corps of Engineers.
Leading Experts. Jones Fortuna's attorneys are water law and Clean Water Act experts. Jones Fortuna is also the Nation’s leading experts on securing water supplies from federal reservoir projects. The firm has extensive experience with the Section 404 permitting process; the NEPA process for major, controversial projects; the Endangered Species Act; mitigation banks; and the use and modification of federal dams and reservoirs; and non-federal sponsor contracting issues related to the U.S. Army Corps of Engineers civil works program. Jones Fortuna represents many local governments and water providers on issues related to water supply and water rights, water quality, permitting, regulatory compliance, long-term planning, and rate-setting. Jones Fortuna also maintains a top-tier Clean Water Act and environmental defense practice, representing clients in citizen suits and enforcement matters.
Jones Fortuna's matters span the country from Georgia to the Bering Sea in Alaska. They are nationally significant and have been covered by media outlets including the New York Times, the Washington Post, the Wall Street Journal, and National Geographic.
Market-Leading and High-Value Matters. Jones Fortuna has a proven track record in leading environmental matters. Examples include:
- Representing a broad coalition of halibut users across the Bering Sea and Gulf of Alaska to reduce trawler bycatch. Jones Fortuna secured very large and highly controversial reductions in bycatch limits through the regulatory process and successfully defended those reductions in litigation.
- Representing the Metro Atlanta Water Supply Providers in the “Tri-State Water Wars” litigation, as the firm's attorneys did for two decades at King & Spalding. This has long been considered the single-most critical environmental matter to the State of Georgia.
- Successfully representing water districts and water authorities in efforts to secure water supplies from federal reservoir projects in California, Texas, Georgia, Tennessee, Missouri, and Arkansas.
- Representing Twin Pines Minerals on one of the most controversial projects in the Nation: its effort to obtain a permit to mine titanium near the Okefenokee National Wildlife Refuge. As part of this work, Jones Fortuna successfully litigated matters against the U.S. Department of Justice and environmental NGOs opposed to the project. The firm anticipates receiving all necessary permits to commence work.
- Representing Sea Island Company on a variety of issues, including at the United States Court of Appeals for the Eleventh Circuit in defense of a first-of-its-kind judgment dismissing a Clean Water Act citizen suit under the Supreme Court’s recent decision in Sackett v. United States.
