Trademark
CLL prosecutes, maintains, and enforces trademark rights worldwide for clients ranging from startups to Fortune 500 companies. The scope of CLL’s trademark work is broad. CLL counsels clients from diverse industries on matters including: evaluating the strength of proposed names and marks; clearing, registering and maintaining marks; properly using marks for goods and services; using marks in advertising and campaigns; protecting trademarks in social media; managing trademark portfolios worldwide; anti-counterfeiting, trademark and domain name enforcement; recordation of trademarks with U.S. Customs & Border Protection (CBP); and litigation. CLL’s trademark attorneys practice before the United States Patent and Trademark Office (USPTO), the U.S. Trademark Trial and Appeal Board (TTAB), the United States International Trade Commission (ITC), Uniform Domain-Name Dispute-Resolution Policy(UDRP)service providers, and in courts of general jurisdiction. Copyright
Copyright protection worldwide is a core practice of CLL’s Intellectual Property group. In addition to registering copyright claims and enforcing rights in various forms of media, CLL’s attorneys are pioneers in the significant new copyright challenges presented by the digital revolution. CLL counsels clients in all sectors of their businesses, including advertising, Internet, social media, computer software, technology, virtual and augmented reality. CLL’s experience also covers the more traditional copyright industries, such as book and music publishing, sound recordings, broadcasting, and entertainment. CLL regularly advises several motion picture companies on copyright clearance issues. CLL also frequently gives opinions on copyrightability, fair use, infringement, ownership and title, security interests, and international protection strategies. When clients need or offer copyright licenses, CLL negotiates essential terms. CLL is well-known for copyright litigation expertise. In collaboration with its Litigation practice group, CLL enforces clients' copyright interests and defend their legitimate rights to use the works of others in the courts and through alternative dispute resolution proceedings. CLL’s attorneys also are leaders in the copyright law community. Patent
Patent law is a key part of CLL’s Intellectual Property practice. Members of CLL’s Patent Group have scientific and technical backgrounds in electronics, electrical and mechanical engineering; computer hardware and software; and organic chemistry and materials science. CLL concentrates on complex computer-related inventions; electrical, mechanical, and electro-mechanical devices; Internet-related systems and software; biotechnology; business method patents; and design patents. CLL advises clients on a wide range of domestic and international patents, trade secrets, e-commerce, and infringement issues, as well as transactional matters. In addition, when clients want to take their inventions to market, CLL advises them on their advertising and marketing campaigns and collateral contracts. When litigation is necessary, CLL’s patent attorneys and its Litigation group join forces to form a formidable team enforcing and defending infringement claims.
Trade Secrets
CLL understands that protection of trade secrets is critical for businesses in many different industries and, also, that treating confidential information as trade secrets, rather than seeking patent protection, provides an alternative means of safeguarding valuable formulas, devices, techniques, patterns, processes, data compilations, client lists, and business methods and processes companies use in the conduct of their businesses. CLL has extensive experience helping clients with trade secrets protection, enforcement, and disputes. CLL’s engagements have spanned numerous industries and different types of trade secrets, ranging from software and financial services products to manufacturing methods for sporting goods, to the design of electronic games, to secret food formulas, customer lists and confidential publishing data. In the financial services and software fields CLL has handled trade secrets claims involving a software platform for the electronic trading of foreign currency exchange, software for trading financial derivatives, software for high frequency algorithmic trading of oil and other commodity futures, and financial software for the preparation of revised corporate earnings statements, among other products. CLL has a proven track record of resolving trade secrets disputes efficiently and, where necessary, litigating these disputes to a favorable resolution in federal and state courts throughout the United States.
