Main Areas of Practice:

Intellectual Property Litigation:
Caldwell Cassady & Curry is best known for preparing high-tech cases for trial and trying those cases to verdict. Caldwell Cassady & Curry is particularly adept in patent-heavy courts, including the U.S. District Courts for the Eastern and Western Districts of Texas. The firm's lawyers also provide years of experience before the U.S. Court of Appeals for the Federal Circuit and federal district courts across the U.S. In fewer than 10 years since its launch, Caldwell Cassady & Curry helped clients win more than $2 billion in patent infringement verdicts, including a $440 million judgment in VirnetX v. Apple that was affirmed and paid after the U.S. Supreme Court denied certiorari. The firm has won five consecutive multimillion-dollar verdicts against Apple in patent infringement disputes involving multiple technologies. Caldwell Cassady & Curry successfully defended World Programming Limited, YUM! Brands Inc., Luminex Software Inc., Pizza Hut Inc., and Shaw Industries Group Inc. in a high-profile copyright and patent infringement lawsuit filed by competitor SAS Institute in the U.S. District Court for the Eastern District of Texas. Caldwell Cassady & Curry secured a complete defense victory for World Programming when the trial court dismissed SAS Institute's claims with prejudice.

Commercial Litigation:
Caldwell Cassady & Curry represents companies and individuals as plaintiffs and defendants in various business disputes and class action claims, including cases involving trade secret misappropriation, fiduciary duty allegations, and disputes involving company founders. In Grace v. Apple Inc., Caldwell Cassady & Curry represented a class of plaintiffs in the U.S. District Court for the Northern District of California when Apple allegedly chose to purposely break the popular FaceTime video chat feature included in iPhones and other Apple devices. After defeating Apple's multiple attempts to dismiss the case, Caldwell Cassady & Curry secured class certification for all Calfornia class plaintiffs. The litigation settled on favorable terms when the trial court denied Apple's pretrial motion for summary judgment. In Morley v. Square Inc., Caldwell Cassady & Curry represented Washington University in St. Louis professor Dr. Robert Morley, inventor of the famous Square credit card reader, in his claims against Square Inc. and fellow Square co-founders Jack Dorsey and Jim McKelvey. The litigation in the U.S. District Court for the Eastern District of Missouri included Dr. Morley's claims for patent infringement, breach of fiduciary duty, misappropriation of trade secrets, wrongful exclusion of Dr. Morley from the company, and related business torts. The parties reached a mutually agreeable settlement ahead of trial.
