Business Disputes:
The members of AMG’s litigation and trial practice department are recognised among their peers and the judicial community as proactive and skillful advocates. The firm’s lawyers have handled and currently manage hundreds of commercial litigation matters, including all manner of contract disputes. Members of the litigation and trial practice department also routinely handle matters related to trademarks and intellectual property. In addition, its litigators have developed positive working relationships with several well-known large law firms across the United States, and it prides itself on its up-to-date and in-depth knowledge of Puerto Rican and stateside commercial law and litigation practice. AMG’s litigators include two former Presidents of the Puerto Rico chapter of the Federal Bar Association, a former chair of the litigation department of one of Puerto Rico’s largest law firms, and a former member of one of New York’s premier litigation practice groups. The litigation and trial practice department recently obtained an important victory in a trademark case before the Puerto Rico Supreme Court, Bedrosian-Heres, et al. v. Nestlé Purina Petcare, et al, 2020 T.S.P.R. 158.
Labour and Employment Law:
The firm’s labour and employment department is experienced in all areas of labour and employment law, including legal counseling in cases of wrongful discharge, employment discrimination, workplace retaliation, wage and hour claims, employee benefits, and Employment Practices Liability. AMG’s labour and employment practice includes representation of employers in cases before federal and Puerto Rico courts, as well as administrative agencies. AMG’s attorneys also represent employers in the public and private sectors with claims and proceedings involving union campaigns, negotiation and administration of collective bargaining agreements, and labor arbitrations. AMG labour and employment law attorneys also have extensive experience in reorganisation of businesses, reductions-in-force, plant closings and mergers and acquisitions. Members of AMG’s labour and employment department also provide services in the area of employment-based immigration, including H-1B visas for professionals and individuals with specialised knowledge; L visas for intra-company transfers of executives, administrators, professionals and individuals with specialised knowledge; E visas for treaty investors and treaty traders; Labor Certifications; employment-based Permanent Resident Petitions and naturalisation. AMG’s labor and employment law attorneys are the current Puerto Rico contributors to the Executive Remuneration Review and Chambers Global Practice Guide (Employment).
Tax Issues:
AMG has prominent tax attorneys, including a former Assistant Secretary of the Puerto Rico Treasury Department. Members of the firm’s tax department are frequent lecturers and speakers about tax and estate matters. AMG’s tax attorneys regularly negotiate with the Puerto Rico Treasury Department; advise clients in the areas of tax planning (corporate and individual), employee benefits, tax incentives; provide assistance in all areas of estate planning; and have a successful track record of tax litigation.
Commencing Business Operations in Puerto Rico:
AMG regularly assists out-of-state businesses in structuring and implementing their Puerto Rico operations, as well as helping start-ups with the formation of a corporate business entity and all related permits and issues, as well as the associated labour and employment matters. AMG’s attorneys are also well-versed in Puerto Rico’s Economic Incentives Law and regularly negotiate tax grants with the Puerto Rico Industrial Development Company.
