The Department is led by a former President of the Competition Commission (COPROCOM), Claudio Donato Sr.
The firm has extensive experience in the direction of legal procedures before COPROCOM and the sectoral competition authorities, both as defendant and claimant. Our firm served as legal counsel of the claimant in a process which lead to the highest fine ever imposed by the Telecommunications Superintendency (sectoral competition authority) Costa Rica. Since the introduction of the mandatory authorization of concentrations regime we have successfully obtained the authorization for more than 45 concentrations
We truly believe that, in this area of practice, prevention is the best defensive mechanism. We are actively engaged in the development of compliance programs, including the draft of internal guidelines and policies, training of personnel and audit of companies.
During the past years we succesfully notified seven concentrations before the Competition Authority in the fields of: Pharma, Superior Education, Retail, Hospitality, Electric Devices, Vehicular Inspection and Agro-industrial sector. We have also worked closely on the development of compliance programs for our clients in all sectors. The past year we have also served as lead counsel in 3 cases for presumption of anticompetitive practices in administrative and judicial levels.
