  • Skadden represented Airlines for America, the National Air Carrier Association and the International Air Transport Association before the Fifth Circuit in a challenge to a Department of Transportation rule regulating the disclosure of airline ancillary fees. The court stayed the rule pending review and ultimately held that the Department violated the Administrative Procedure Act by relying on new data without affording the public an opportunity to comment.
